OPEN LETTER TO INCOMING CUYAHOGA COUNTY PROSECUTOR Michael O’Malley
Dear Prosecutor O’Malley:
We are writing this open letter to express our deep concern and urgent desire for justice in the unresolved Nov. 22, 2014, shooting death of Tamir Rice.
The shocking video of this tragedy has been seen worldwide and shows that Patrolman Timothy Loehmann shot this 12-year-old child less than one second after getting out of his squad car. This was premeditated summary execution of a child who had a toy gun in his waistband. Making this incident even more outrageous were the actions of all the officers present who made no effort to provide first aid, but instead tackled Tamir’s 14 year old sister and handcuffed her while she was face down in the snow, then locked her in a squad car next to where her brother lay bleeding and threatened their mother with jail as she tried to reach her fatally wounded son.
Unless there is accountability in this case, anyone can be similarly victimized. The principle must be firmly established that police who use deadly force when other options are available must defend their actions in court. Otherwise police will have authority to carry out arbitrary and summary executions, a power characteristic of police states.
The eyes of the world are on Cleveland and your actions will have a profound impact on how our community and country operate and are viewed by the rest of the world.
With this in mind, we the Tamir Rice Justice Committee are circulating a petition that’s demanding the officers responsible for Tamir’s death be charged and prosecuted. Our community deserves its day in court. Otherwise, there is no doubt that tragedies like this will continue to happen.
