We, the homeowners, the neighbors, the residents, and the friends of Kirkwood Heights Subdivisions and Piedmont Subdivisions hereby petition the City of Huntsville to DENY any application to form a new subdivision called Kirkwood Heights, Fourth Addition from any property currently within Kirkwood Heights, and specifically the property at 125 Wingate Ave SW, Huntsville, AL. 35801 (Parcel 18-03-07-3-001-044.000, Legal Description LOT 1 BLK 5 KIRKWOOD HGTS PB 1 PG 320).  This property on the southeast corner of Wingate Ave SW and Hastings Rd is inside Kirkwood Heights and the proposed new subdivision violates the original covenants and restrictions for both minimum width and minimum lot square footage for all properties inside Kirkwood Heights.  The developer of 125 Wingate Ave SW acquired the property from the estate of a WWII veteran who survived the battle of Midway, and who lived in his home in Kirkwood Heights for 60 years.  The developer knocked down the home and plans to build TWO large two-story "shotgun" style homes approximately 35’ wide and 75’ deep and ~3500SF each by creating a new "subdivision" that divides ONE lot into TWO, ignoring our covenants, which specifies ONE single-family dwelling on each lot.  We would welcome ONE large single-family home on this lot! 

We also petition the City of Huntsville to SUPPORT and ENFORCE the original, still applicable covenants and restrictions on any new construction in Kirkwood Heights (as recorded in Deed Book 0245 Page 0015 Probate Records):  Lots must be a minimum of 85 feet in width and 11,900 square feet in area.   The "big lots" portion in Piedmont is even more vulnerable due to bigger lots and less restrictive R 2-A zoning that allows duplexes, townhouses, and even apartments.

We also petition the City of Huntsville to NOT SET A PRECEDENT that would likely apply to other corner lots (or every lot!), which would fundamentally change this part of our Piedmont neighborhood from its original design.   

The City of Huntsville has made it clear the only way to enforce our covenants is "civil action."  We have retained legal counsel to "Stop the New 'Subdivision'".   Please donate to the Kirkwood/Piedmont Litigation Fund (100% of funds donated go to legal expenses).  https://gofund.me/a237c846
