I’m requesting that the City Council meeting, set for April 7 be postponed for the following reasons: 

  1. The 9th Circuit will soon decide on case #19-701; Oral Arguments regarding the 2018 Streamlined Rules. Once the court has reached its decision, the City will have a better understanding of how to move forward with this infrastructure as well as with a Master Agreement. 
  2. The COVID-19 shutdown provides the City with the opportunity to delay without any negative impacts.  The meeting should be postponed until the COVID-19 Shelter in Place is lifted.
  3. The public must be present in order to form robust public comments and in order to capture the intent of what public meetings should be. Virtual meetings can not meet the demands of a public meeting.
  4. This meeting is about signing a Master Agreement with Verizon and ExteNet. But, there are also antennas that have been approved at various locations around Walnut Creek. This also needs to be discussed.
  5. Has public notification gone out about antenna locations? Why? I believe public notification is a very important step, especially because these microwave radiating antennas will be installed in public areas. This also shows the City is transparent with their decisions and fulfills due diligence requirements. 
  6. I have requested, but not received a list of approved Wireless Telecommunications Facility locations.  I need time to evaluate the details of these locations.
  7. Public participation for the April 7 meeting is not safe for staff or the public. We should wait until we can come together in a public forum. This American foundational right can not be fulfilled with a Zoom conference.
