In 2012, Chicago Mayor Rahm Emanuel passed the “Welcoming City Ordinance” that prevents federal agencies from inquiring about the immigration status of people seeking city services. Additionally, it prohibits collaboration between Immigration and Customs Enforcement (ICE) and local police, and does not allow for local police to question the immigration status of citizens. Mayor Rahm Emanuel said that the ordinance would “make Chicago the most immigrant-friendly city in the country”. The ordinance outline the ways in which the city will ensure that Chicago remains a sanctuary city for immigrant communities. However, there are four exceptions to the ordinance, which will allow for the collaboration between ICE and the City of Chicago.


Chapter 2-173-042 Civil Immigration Enforcement Actions- Federal Responsibility

(c) This section shall not apply when an investigation conducted by the agency or agent indicates that the subject of the investigation:

(1) has an outstanding criminal warrant;

(2) has been convicted of a felony in any court of competent jurisdiction;

(3) is a defendant in a criminal case in any court of competent jurisdiction where a judgment has not been entered and a felony charge is pending; or

(4) has been identified as a known gang member either in a law enforcement agency's database or by his own admission


These exceptions disproportionately impact black and brown communities. Due to the errors within the Chicago Gang Database and racism within the criminal justice system, the exceptions should not be valid reasons for city cooperation with ICE. ICE terrorizes immigrant communities and is upheld through racist ideology of white supremacy. Therefor, the City of Chicago should remain a true Sanctuary City by ending all collaboration with ICE.
