Middletown NJ Planing Board - Village 35 Combined Application

 At the June 15th 2016 Planning Board meeting, it was announced by James H. Gorman, Esq, Board Attorney, and Mr. John Deus, Board Chairman, that the applications for Village 35 (commercial development at Kings Highway East and Rt 35) and Toll Brothers Middletown Oaks (residential development on Kings Highway East) would be heard as a combined application before the Planning Board. 

The rationale for this is one the community supports:  both parties will use the same traffic engineer as expert witness for their application, and there is a combined open space allocation across both developments.  Further, there are numerous aspects of the combined development, such as the connector road, wetlands and drainage and buffer zones that are difficult to discuss in isolated conversations.  The community welcomes and applauds this decision.

As of August 23rd, Toll Brothers has NOT filed a completed application with Middletown Planning Department.  Therefore, the residential component will not be ready by the scheduled September 7th 2016 Planning Board meeting when the combined application was scheduled to be heard. 

This petition is therefore alerting Mayor Scharfenberger to this fact; and formally requesting that James H. Gorman, Esq hold firm the decision made at the June 15th Planning Board. 

The community has been informed on the record that this application will be reviewed combined.  To change this decision without advising affected residents seems extremely unfair at this late stage, and places the public at a disadvantage. 

If the June 15th decision is to be reversed for any reason, then we request that formal notification of same is sent to those residents that live within the 200 feet buffer zone in particular, and that public notices are placed in the relevant newspapers with a full explanation regarding the decision and the how the process will work moving forward.
