Stop unsolicited political propaganda in Malta

This petition had 81 supporters

The ever-increasing volume of unsolicited political propaganda being received via email and SMS is reaching absurd heights, so much so that it is now bordering on harassment, and cannot be left unaddressed.

Not only is this inconsiderate, unethical and exasperating, but it is also in breach of the Data Protection Act, and therefore illegal:

Article 9 of Subsidiary Legislation 440.01 stipulates that a person cannot use, or cause to be used, any publicly available electronic communications service to make an unsolicited communication for the purpose of direct marketing by means of automatic calling machines, faxes and email unless the subscriber has given his prior explicit consent in writing to the receipt of such a communication.

We are aware that this issue has already been brought up more than once in the past, and that both major parties were already found guilty of this breach, but current events are proof that the formal warning they were given in July 2012 was not enough, and they are blatantly refusing to obey the information and data protection commissioner, and therefore the law.

We demand that the information and data protection commissioner does everything within his/her power to investigate, or conclude any existing investigations in this regard, in a timely manner, so that any illegally obtained or illegally stored personal information is immediately deleted, all culprits are made to face the consequences as prescribed by law, and the citizens' right to privacy is upheld.

We would be more than happy to provide proof to back our claims, in the form of emails, but mainly in the form of SMS, of which sometimes five are received in one day.

We encourage you not only to sign this petition, but we also highly recommend that each and everyone of you sends a formal complaint to the data protection commissioner here:  https://idpc.gov.mt/en/Pages/contact/complaints.aspx

If you are fed up of the situation, this is your chance to do something about it.
