Hello, my name is Amy and I am a single mother of twin 6 yr old boys diagnosed with autism.  When one of my sons was 2 years old I began to notice changes in his behavior and mannerisms that caused me concern.  I had had him evaluated and he was diagnosed with autism at age 3.  His twin was diagnosed 6 months later. 

Both of my sons have challenging behaviors and desperately need Applied Behavioral Analysis (ABA) and other therapies to treat their autism.  However, my very large, national and multi-billion dollar employer is self-funded and has denied coverage for their services in violation of the ADA (Americans w/Disabilities Act) and ERISA/MHPAEA (Mental Health Parity Act) 

As a result, I am pursuing a litigation against my employer hoping to compel it to cover my sons’ ABA therapy.  I have also asked the Court to compel my employer to cover ABA therapy for the rest of the children of my fellow employees and to rule that it is a violation of federal law for my health insurance plan to exclude ABA therapy.  We have won some notable rulings but trial is almost a year away, and me and my children need your help! 

Autism is not curable BUT it is so treatable with the right therapy.  ABA is the primary therapy accepted by the medical community to treat autism.  It needs to be provided intensely and as early as possible to give children like mine and my fellow employees a chance for best possible outcomes.  Unfortunately, after 2 years of fighting, my employer continues to stand its ground and deny ABA services to my children and the rest of the children of its employees.

When asked by my legal team why I was choosing to take a stand against my huge employer my response was this.  "I am fighting for my son's who don't have a voice, the other families in my company and the autism community across the world.  Litigation is expensive and my children have not gotten the ABA and other therapies that they need while I pursue this fight on behalf of everyone!   They've missed almost 2 precious years and have regressed in so many ways.  Please help me in getting the word out there to have this changed. 

We have State Mandates but no Federal Mandates to protect anyone with ERISA/Self-Funded Plans.
