WE, the INDEPENDENT ARTIST OF Malaysia, 

NOTING  

Item 3 on the Collective Management Organization (CMO) and ;

Item 4 on the Guidelines for Collective Management Organization ;

Specified under the Bil 1/2021/CP/tb would like to express our plead as Artist and Copyright Owners on the concerns that we had been enduring till today due to the power vested by the Licensing Body given under S27A of the Copyright Act 1987 that had been unjustly enforced on us from the creative industry.  

Actions/Inaction by Licensing Body that had been unjust : 

By deeming to be the only form of avenue for the Artist to have their creation copyright protected.
 

By deeming to be the only legally authorised collector of royalty.

By claiming to own all rights to Artist past, present and future creation.  
 

By having no accountability and transparency on how the distribution of Artist royalty are accounted for and how it is being distributed. 

Not acting in the best interest of the Artist 

We Urge and Plead to the respective Ministry KPDNHEP to address the issue by the following recommendation to be included as consideration on the amendment to the 1987 Act : 

 

Impose complete transparency of the entire process from collection of royalty to the distribution of royalty
 

Impose strict accountability and justification for every ringgit collected and spent and distributed 

Return the Artist’s right as the creator and owner of the creative content  

Brief and clarify to us all as creative content creator before any part of the amendment is tabled, what this amendment changes compared to the 1987 Act and how this amendment may affect our rights
