City of Boston ZBA: Make Bicon Play by the Rules

Dear friends and neighbors,
Thank you so much for your past support of our work to stop the demolition of #21 Yale Terrace by Bicon Dental Implants. As you know, we lost that fight and the house is now gone.
As you can imagine, we are now focused on ensuring that anything that happens on that lot is consistent with the residential character of our neighborhood. We are working hard to ensure that all public review standards will be upheld.
Unfortunately, we must also seek to correct some problems from the past. Specifically, we have asked the Boston Zoning Board of Appeal to rule that Bicon is currently operating without valid occupancy permits in their current location. We (the neighbors) think this should be corrected immediately.
Here is the issue: Bicon operates a dental clinic and a professional school in their current building. These uses require a conditional use permit (for the clinic and lab) and a zoning variance (for the professional school), yet they never applied for nor were required to seek such permission. Consequently, we (neighbors and abutters) were denied the opportunity to express our concerns about their plans, and they were issued permits without due process.
The Yale Terrace Neighborhood Association has asked ISD to revoke their occupancy permits until they have gone through the proper channels seeking their zoning variance. ISD has refused to do this.
Now we are appealing that decision at the Zoning Board of Appeals (ZBA). We believe that Bicon should be held to the same standards of community review for their industrial work that you and I would be, if, for example, we wanted to add a porch. More importantly, we believe that establishing and accurate and clear record is the best -- in fact, the only – way to make sure that any future uses or expansion plans can be properly evaluated by the community.
Please consider signing our request that the ZBA overrule ISD and grant our request for Bicon's occupancy permits to be revoked until they have properly applied for and received the necessary permits and variances under the zoning code.
