This site is in the process of making a major revision; but with your petition signature in tact along with your comments. Plans to proceed are being addressed with the same goal in mind.

      This access road  on the Southside of  Lower Twin Lakes is a safe road on to Lower Twin Lakes for wintertime activities; such as, snowmobiling , ice fishing, sled pulling,  and this access has been closed with an iron gate and posted "NO TRESPASSING " signs.

  This access  has been used by the public for some 43 years.       Residents of Blueberry Township and residents of the region began to use it for wintertime activities ; such as, snowmobiling, ice fishing, and sled pulling. From the time of freeze up (approximately Nov. 1- Feb. 28th) of each year.The public had been able to use it freely, anytime, day or night.

The fact that it has been used for over 15 years, and there has been  open, continuous, visible, and unmolested use of this plot of land ; as a public road, under Minnesota  law the public acquires an easement by prescription. This law prevents an owner from closing it without the public's  consent or operation of law, and a  tax  title of conveyance does not terminate the public's  rights therein .

 In this  instance the owner failed   to take into account all of the people who have used the access for the past 43 years. And this is where the problem  is.                                                                                                                                                                                                                                                   

    It is crucial that the township residents at this time assert their  rights  to travel this public road as an access on to the lake; If we, the public do not act,  the opportunity to keep this access for  the township residents and regional residents will be lost for current and future generations to use as the safe way on to Lower Twin Lakes. We, the public need a prescriptive easement ; as prescribed by the public. Nov. 1 -Feb. 28t of each year.

      I have lived across from this access for some 43 years prior to it's closure. Over the years I have seen fathers and grandfathers; as well as, mothers;  and grandmothers using this access for  leisure time activities with their loved ones. It is truly a township asset that should be kept for all to use, at least for  the four winter months: Nov.1-Feb. 28th of each year. It is not needed during the summer months; as there is a DNR access by the bridge that is available  for summer time lake activities.  The DNR access by the bridge is a dangerous  access on to the lake , with the swift current of the  Shell River always undercutting the ice.

        As residents of Blueberry Township and the region ; we can  take a positive step toward maintaining a safe access on to Lower Twin Lakes for current generations and future generations .

      The "Save the Access " group that has just started to form asks for your support by having you attest to your support with your signature. In addition there is a short access road usage questionnaire that would be information needed to obtain  a prescriptive easement with supporting evidence.
