SCHEDULE 6, BILL 229 DISCUSSION

A major function of Conservation Authorities' is to protect the people, infrastructure, and most importantly, the environment. The core mandate is to "undertake watershed-based programs to protect people and property from flooding and other natural hazards, and to conserve natural resources for economic, social, and environmental benefits." Scientific experts at Conservation Authorities' ensure that we are not building recklessly in wetlands and flood plains. Their work reduces the risk of flooding, which is already getting worse due to climate change. Conservation Authorities' use science to fulfill their mandate of protecting communities and conserving natural resources.

Schedule 6 - Conservation Authorities Act, of Bill 229 - Protect, Support, and Recover from COVD-19 Act, drastically reduces the ability of Conservation Authorities to fulfill their mandate of protecting people, infrastructure, and the environment. This will also allow the Minister of Municipal Affairs and Housing to force Conservation Authorities to issue development permits even if those permits go against their provincially delegated protection responsibilities. Schedule 6 creates a two-tier system that allows individuals to bypass well-established watershed policies and science-based regulations that serve to guide decision-making to protect our communities and natural environment.

This will hurt Ontario's environment and our unique watershed approach. This legislation limits the ability of Conservation Authorities to protect life, property, and environment. It undermines the power of Conservation Authorities' to do their job. It undermines the ability of Conservation Authorities to make non-political decisions based on science. These changes significantly either limit or completely change the role of Conservation Authorities in protecting Ontario's environment and ensuring people and property are safe from flooding and other natural hazards. 

Forced approved permits may cause flooding and erosion and jeopardize human health and safety. Any conditions to mitigate risk imposed by Conservation Authorities could be appealed by the landowner or developer to the Minister directly, or to the Local Planning Appeals Tribunal (LPAT), a body with no experience rendering decisions related to Conservation Authority permits. This would prevent Conservation Authorities from fulfilling their core mandate of watershed protection, thus the sound management of natural hazards and natural resources. 

The Province states that these changes were added to aid in financial recovery from the pandemic, however, they could have passed a budget bill without adding negative impacts to the successful watershed management model in Ontario. Instead, they chose to sacrifice our natural resources to appease developers and big corporations. These changes have little to do with the economic well-being of this province and more to do with aiding the financial recovery of these developers. 

This issue is compounded by the amendments to Bill 257 - Supporting Broadband and Infrastructure Expansion Act, Schedule 3 - Planning Act, which allows Ministerial Zoning Orders (MZOs) to override key provisions of the Planning Act. This means that when an MZO is issued to permit development, it will no longer have to be consistent with Ontario's fundamental planning principles outlined in the Provincial Policy Statement (PPS).  *** information contained in this petition has been retrieved from other sources ***

This petition is asking the Legislative Assembly of Ontario to immediately remove Schedule 6 - Conservation Authorities Act, from Bill 229 - Protect, Support, and Recover from COVID-19 Act.  

To the Legislative Assembly of Ontario:

WHEREAS          Schedule 6 – Conservation Authorities Act, of Bill 229 – Protect, Support, and Recover from COVD-19 Act, drastically reduces the ability of Conservation Authorities to fulfill their mandate of protecting people, infrastructure, and the environment.

WHEREAS          Schedule 6 – Conservation Authorities Act, of Bill 229 – Protect, Support, and Recover from COVD-19 Act, allows the Minister of Municipal Affairs and Housing to force Conservation Authorities to issue development permits even if those permits go against their provincially delegated protection responsibilities.

WHEREAS          Schedule 6 – Conservation Authorities Act, of Bill 229 – Protect, Support, and Recover from COVD-19 Act, prevents Conservation Authorities from making appeals to the Local Planning Appeal Tribunal (LPAT) and allows the Minister of Municipal Affairs and Housing to bypass Conservation Authorities and issue permits himself. 

WHEREAS          Schedule 6 – Conservation Authorities Act, of Bill 229 – Protect, Support, and Recover from COVD-19 Act, creates a two-tier system that allows individuals to bypass well-established watershed policies and science-based regulations that serve to guide decision-making to protect our communities and natural environment.

WE, the undersigned, petition the Legislative Assembly of Ontario as follows:

To immediately remove Schedule 6 – Conservation Authorities Act, from Bill 229 – Protect, Support, and Recover from COVID-19 Act.
