Of late, it has become a fashion to book sr officials u/s 306-abetment  to suicide to victimise them for demanding performance and the 1st step police takes is to move for arrest of these sr officials. Unfortunately, it has created a fear psychosis amongst these sr officials so much that they cannot demand performance from non performing employees. Often the non performing employees threaten the sr officials of misuse of this act. The situation leads to encouragement of non performing employees.

The position as on date is boss cannot demand performance from juniors, lender cannot demand recovery of amt lent from borrowers, parents cannot ask their children to mend their ways etc etc.

My feeling is that 90% of cases registered u/s 306 are not genuine and meant only to victimise the higher officials, lenders and parents.

Amemdments are required in the act that case should be registered only after thorough investigation by police at a senior level and arrest be made where there are chances of persons fleeing the country.
