• ¿Quien es Nelson Serrano? Who is Nelson Serrano?

Nelson Iván Serrano Sáenz, descendiente directo de nuestros libertadores, nació en Quito-Ecuador el 15 de septiembre de 1938.

Después de terminar el colegio salió del país para estudiar agronomía en Argentina graduándose en la Universidad de Rosario en Argentina, culminados sus estudios regreso a Ecuador. En Mayo de 1964 a los 25 años decidió irse a trabajar en Estados Unidos, como muchos latinoamericanos.

Nelson Ivan Serrano Saenz, a direct descendant of our South America’s liberators, born in Quito, Ecuador on September 15, 1938. After finishing school, he left Ecuador to study agronomy in Argentina graduating from the University of Rosario, and returned to Ecuador. In May 1964, at age 25, he decided to go to work in the United States, as many Latin Americans did.

El caso comienza cuando Nelson Serrano en 1984 emprende su propio negocio. Seis años después traslada la empresa a Bartow, Florida, donde se asocia con Felice Dosso y George Gonsalves. En junio de 1997 Nelson dejó la presidencia de su empresa Erie Manufacturing luego de iniciar un juicio civil en contra de sus dos socios por faltantes sumas de dinero.

En ese mismo año siendo un 3 de diciembre de 1997, uno de sus socios y tres personas fueron asesinadas. Sr. Serrano cooperó con las autoridades aunque fue investigado como sospechoso y, después de tres años, el caso, sin resultados, fue clasificado frío.

Es así que Nelson totalmente libre, sin cargos en su contra, sin pruebas por mas de cuatro años a pesar de que el fiscal lo trataba de incriminar, sin resultado alguno, se jubila y regresa a Ecuador en el 2000, dos años mas tarde (2002) dos agentes estadounidenses, fiscal y detective de la Florida, secuestran a Nelson de nuestro país sobornando a policías ecuatorianos para llevárselo a USA violando sus derechos humanos y vulnerando la soberanía del Ecuador.

Lo tuvieron  4 años en una prisión de alta seguridad sin proceso penal alguno. En el 2007 sin evidencia, sin sustento legal  es sentenciado a cuatro veces a pena de muerte. 

Actualmente Nelson Serrano lleva luchando ya 18 años por demostrar su inocencia, ante un sistema que no admite sus equivocaciones, ya que existen intereses particulares en donde el poder es mas fuerte que la justicia.

El Ecuador ha declarado su deportación ilegal, reconoce que sus leyes internas y las leyes internacionales han sido violadas. La Comisión Interamericana de Derechos Humanos después de realizar sus investigaciones reconoce también las violaciones cometidas por las autoridades de ambos países que incluye la falta de debido proceso, de mantener al Sr. Serrano incomunicado, sin poder contratar su propio abogado y que le metieron en en una jaula de perros en la área canina del aeropuerto la noche antes que le sacaron del país.

Los esfuerzos por resistir de Nelson han sido arduos pero a sus 82 años el tiempo es un enemigo, cada vez su salud se deteriora, firma para poder salvarlo, luchemos para salvar una vida. Nelson dice, “Mi fé en Dios y en la verdad me da fuerza en sobrevivir estos últimos 18 años. No me rindo porque soy inocente.”

Pedimos que sea revisado su proceso, que sea juzgado por jueces imparciales que revisen las pruebas de acuerdo a los hechos, el ADN y testimonio del único testigo ocular recientemente presentado a la corte comprueba la existencia de otra persona que no es Nelson Serrano, pero el estado no quiere reconocer su error. Estamos apelando estas decisiones pero como creen que a nadie le importa la vida del Sr. Serrano están confiados que no lo tienen que reconocer. Aquí pueden ayudar y demostrar que valoramos su vida y no nos quedamos callados mientras planifican matar al primer ecuatoriano en la historia del corredor de la muerte estadounidense.

Por un acto humanitario solicitamos la revisión integral del caso de Nelson Serrano para que pueda regresar a su hogar en Ecuador. 

• Why save Nelson Serrano?

The case began in 1984 when Nelson Serrano started his own business. Six years later, the company moved to Bartow, Florida, where it is partnered with George Gonsalves and Felice Dosso. In June 1997, Nelson left the company after filing a civil lawsuit against his two partners for missing sums of money.

In that same year, on December 3, 1997, one of its partners and three other people were killed including an assistant district attorney. Mr. Serrano cooperated with authorities although he was investigated as a suspect and, after three years & without results, the case was classified cold.

Nelson, without charges or evidence against him after almost three years, retires and returns to Ecuador in 2000. Two years later, an assistant state attorney and a detective from Florida, conspire and effectively kidnap Nelson from the streets of Quito. Bribing Ecuadorian police to take him at gunpoint, they bring Nelson to the US in violation of his human rights to due process, amongst other violations, and violate the sovereignty of Ecuador, its national laws, international laws as well as the extradition treaty between the two countries.

He was held for four years in a high security prison without any criminal proceedings. In 2007, without evidence, without legal basis, in a completely circumstantial case, he is sentenced: The Death Penalty.

Currently Nelson Serrano has been fighting 18 years to prove his innocence within a system that will not admit its mistakes and where political interests are stronger than justice.

Ecuador has declared Nelson’s deportation was illegal, recognized that its domestic laws, its sovereignty and international laws have been violated. The Inter-American Commission on Human Rights, Organization of American States, after doing their independent research also recognizes the violations committed by the authorities of both countries, including the lack of due process, being held incommunicado, unable to hire his own lawyer and from being placed overnight in a dog cage of the airport’s canine area before he was boarded on a 7 am Sunday flight to Miami.

Nelson’s efforts to survive on Death Row have been arduous, to say the least, but at the age of 82, time is an enemy as well as his deteriorating health. Sign and share this petition to save a life. We ask that the case and its evidence be reviewed by impartial judges and a new trial be granted. DNA of the killer and testimony of the only eyewitness recently submitted to the court verifies the existence of another person who is not Nelson Serrano, but the State refuses to recognize that if this new evidence would have been presented during the original trial, the jury would have ruled Serrano was innocent. We are appealing these decisions. If the Florida judicial system continues to believe that nobody cares about the life of Mr. Serrano, they will not grant a new trial in order to protect the careers of their prosecutors.
