Prosecute the 4 grocery store employee's that attacked my husband

Why are the people who attacked my husband not being prosecuted, they broke an Ohio law  ORC2903.12 Aggravated assault.
(A) No person, while under the influence of sudden passion or in a sudden fit of rage, either of which is brought on by serious provocation occasioned by the victim that is reasonably sufficient to incite the person into using deadly force, shall knowingly:
(1) Cause serious physical harm to another.

My husband was at the grocery store and had just completed a purchase when an employee stopped him and without saying anything proceed to check his pockets, they had thought he had stolen something. He had not, when he told the employee not to touch him the employee grabbed my husband, and my husband pushed back and then my husband  was grabbed from behind and one employee started to choke him while making racial comments. When the police arrived my husband was struggling to breath, while the police officers held a taser on him telling him to stop fighting, but he was not fighting them he was fighting to breath, since the one employee had a death grip on his neck. The police handcuffed my husband and placed him in the car then went into the store and took statements from the employee's they also reviewed the tape, then they released my husband and told him to never come back into the store never taking my husband's statement. My Husband was profiled as a thief for the color of his skin then instead of arresting the men that attacked him the police told him he could go and never come back on the property. When we went to the police station to file a complaint and for him to make his statement, we were told that we could not because the officer wrote the complaint up as a disturbance and the store had declined to press charges. The store was in the wrong the employees broke an Ohio law 2903.12 Aggravated assault.
(A) No person, while under the influence of sudden passion or in a sudden fit of rage, either of which is brought on by serious provocation occasioned by the victim that is reasonably sufficient to incite the person into using deadly force, shall knowingly:
(1) Cause serious physical harm to another.
My husband left the store with a swollen neck, scratches on his neck, glass in his hand, bruises on both his legs, and a knot on his ankle. It surprises me that these men where not arrest at the time but to continue to block my husband from giving his statement and pursing charges is a gross in justice.
