In 2012 my daughter was taken from me at a month old with false allegations made by her father that I threaten to kill her. Her father filed an emergency hearing without my knowledge, I was served with this hearing on Thanksgiving of 2012 and had to attend court that Monday morning leaving me no time to obtain legal counsel or review my options. I was unaware at the time, but i am aware now that I was unjustifiably served as the SC State Law states that a party must be given a minimum of 5 days notice, i was only given 2 days.

After a stressful 2 years of fighting in court with barely any legal counsel and going up against my daughters father who had military paid legal counsel it was found by the courts that the allegations made against me 2 years prior where false and no evidence to support this ever happened could be found. The courts however decided that they did not want to change my daughters living arrangements and thats where my saga begins.

My daughter was placed in her fathers custody legally on May 12 2012, it was ordered that I was not to loose my relationship with my daughter and steady visitation for co parenting was put in place. I have not seen my daughter since that day 11 years ago. Because of the non existence laws on parental alienation and the blurred lines for rights of non-custodial parents my daughter has went with out a mother for 11 years, she was even told by her father I died on her birthday in 2020.

use of the blurred lines, even with visitation order in hand, the police would not pick my child up and enforce my order. The courts failed to educate me on my legal rights and the only thing I could do was find the money for a good lawyer, which i must say is very costly in family court.

If I fail to pay child support I am arrested, possibly given time and some, but there is no laws in the State Of SC that holds a custodial parent responsible for not following their portions of a legal binding court order. Because of the broken system here i was not only kept away from my daughter for 11 years, she was led to believe her mother was deceased.

I want to change this, it wasn't until I went public with my story that I realized how many men/women are unjustly being alienated from their children. The only thing they can do is fight in court and most can't afford to do that with the cost of legal aid for child custody and family court. 

If a non-custodial parent can be arrested for not complying with the order and failing to pay child support then a custodial parent should be held just as accountable for not following their order. I would have never lost 11 years with my daughter if the laws protected non custodial parents as they do custodial parents.

Kyliyah's Law will make all visitation orders include wording that enforces actions by the local police department when a child is not being handed over to the non-custodial parent during visitations. A law that will have the custodial parent arrested for not handing over a child when there is a court order in place to due so instead of just giving the non custodial parent a form to fill and out and sending them back to family court just to have nothing done.
