A new Equality Act came into force on 1st October 2010. The Equality Act brings together over 116 separate pieces of legislation into one single Act. Combined, they make up a new Act that provides a legal framework to “protect the rights of individuals and advance equality of opportunity for all.”
The New Act simplifies, strengthens and harmonises the current legislation to provide Britain with a new discrimination law which protects individuals from unfair treatment and promotes a fair and more equal society.
However section 165 of the Equality Act 2010 has not yet been enacted even though the new legislation had been drafted in October 2010. This particular section looks at duties imposed on Taxis Drivers when carrying wheelchair passengers.
This section imposes duties on taxi drivers carrying wheelchair passengers and states that these duties should be performed without making any additional charges.
Yet, in the Bradford District as well as other Cities in the UK, Private Hire Operators are overcharging wheelchair passengers double the actual fare and in some cases charging more for using an adapted taxi, (taxis which are designed to carry more than 4 passengers.)
(E.g. If a non wheelchair user took a journey from a Private Hire Operator and they were charged a fare of £10, where as a wheelchair user using the same firm and taking the same route, they could be charged £20 or more when using an adapted taxi!)
This is a clear case of discrimination and unfair to take advantage of any group of people in this way.
Other transport services are able to accommodate disabled passengers such as, buses, trains, boats, airlines and they don’t charge the wheelchair passenger extra but spread the cost equally amongst all their customers. Due to the competitive nature of Taxis, Private Hire Operators will not do this in the fear of losing business!
The piece of legislation that protects people in wheelchairs from being overcharged has not yet come in to play so the government is allowing these unscrupulous drivers to carry on taking “financial advantage” of wheelchair users and the disabled.
We need every ones support in signing this petition please so that we can finally put in place a law that should have been enacted from the start of The New Equality Act 2010, we are nearly three years on and still no where nearer to this happening.
