When our neighborhood was developed almost 20 years ago, the builder constructed part of the entrance structure and sign on County Right-of-Way. This was at no fault to the Home Owners’ Association (HOA). The residents of the community have continuously maintained this land and structure, including refurbishing the entrance structure in the Spring of 2017. The HOA would like to take ownership of the land that our entrance structure and sign reside on in order to continue maintaining the entrance to our community.
Here are some concerns that HOA has:
- The value of the land is approximately $40,200 and is proposed to be given back to the property owner to the north at no cost. If it was sold, the profit of the sale could go to improving our public roads in our neighborhood. Furthermore, if the property is indeed given, then the property owner could potentially subdivide it, demolish our entrance, and possibly make money on land that the County gave away.
- There have been no claims against the land and so the liability to the County has been minimal.
The HOA does not want the entire property, we would simply like the portion that our entrance structure and landscaping is on and that we have been maintaining for the last 20 years.
