As Grandparents in Kentucky we have been denied the right to have reasonable visitation with our Grandchild due to struggles that our son has experienced with Substance Use Disorder.
A change in the wording in this already established law would allow us the right to be reunited with our Grandchild regardless of the reasons they have have been removed from our adult children. Many of the reasons they are being removed is out of our control such as Incarceration, Divorce, Death of our Child, the Court system and just plain vindictive custodial parents.
Currently the courts presume the testimony of the custodial parent to be true and place the burden on the Grandparents to prove them wrong. Leaving the decision solely up to the Judges descretion and bias opinions.
Grandchildren across our state are being denied relationships with their Grandparent, and extended families. Which according to phycologists can cause irreparable emotional damage to the child.
