Human Rights and their defenders are under heavy attacks in Turkey these days. One of the victims is Dr. Serdar Küni, a turkish medical doctor who is sentenced to 4 years of imprisonment for merely doing his job. 

Medical treatment more and more often becomes a game of political, military and foreign interests, which can be devastating especially in war and conflict situations. The attack on doctors and medical independence is seen not only in Turkey, but in many countries, not least in Germany, too.

Dr Serdar's "case" is merely the spotlight, where the problems are presented openly. 

Help prevent his imprisonment  - and thereby set an example against the threat against medical independence worldwide.

About Serdar Küni:

Dr. Serdar Küni has for many years been a doctor at the clinic in Cizre. A town in the region in which in 2016 strict curfews where announced for all people from the turkish military. They claimed this necessary to fight terrorist groups. As a result of these curfews a lot of people got shot from turkish militaries  - because it was not possible to stay in the houses for several days without food or water. Leaving the house was often reason enough to get shot.

Serdar Küni was working at the hospital during this time. He is accused of having withheld information about patients he treated during this time from official lawinforcement authorities - and with this having supported a terrorist group.

He is accused under Article 314/2 of the Turkish Criminal Code. 

Despite any evidence for the allegations made and despite  a huge international interest and monitoring of the court case, Dr. Serdar Küni was sentenced to 4 years and 2 months imprisonment on April 24th.

This is unacceptable, he will appeal to that.  

You can support his appeal! By preference, please send a postal letter to the court until approximately 17 mai 2017, when the case will possibly be decided. Case Dr Serdar Küni, 2017/230

High Court,

We have learned of the trial against Dr. Serdar Küni. We are appalled that he has been sentenced to four years and two months imprisonment by the local Criminal Court in Sirnak on April 24th.

The trial has been observed and evaluated by international observers from several countries.

Accordingly, the trial against Dr. med. Serdar Küni was not fair and the accusations against him were without evidence. Besides all the witnesses who were brought in by the prosecutor's office withdrew their testimonies and said that they were made to sign statements submitted to them under torture or heavy pressure. Almost all of them have not known Dr. Serdar Küni at all or only very briefly. A forensic medicine expert representing defense party was heard before the Court.  He stated that medical records weren't in line with Istanbul Protocol which exhibited the invalidity of them, so that such statements can't still be used in court proceedings according to international standards.

Therefore, we are absolutely convinced that Dr. Serdar Küni is innocent.

The trial also raises fundamental questions: independent medical treatment and medical confidentiality must not be questioned, even in conflict and war situations. This is required by the international human rights covenants as well as the international agreements laid down by the International Red Cross, which regulate medical help in war and other violence situations. Very recently, in April 2017, the World Medical Association in a resolution referred to the process of Dr. Serdar Küni citing these convenants. Dr. Serdar Küni had done nothing else in his work in Cizre, and would have been guilty if he had behaved as asked of him by the Prosecutor. On this point, medical ethics must not be weakened.
