Dear Friends, Residents of Kauai and Visitors of The Hanalei Bay Resort, Bali Hai & Happy Talk Restaurant,

We are seeking your support to humbly request from Kauai County Planning Department to place a 90-day moratorium on the parking plan recently submitted for final approval by the Board of AOAO of The Hanalei Bay Resort.

This plan was stamped and submitted less than two weeks ago to the Planning Department after nearly 40 years of non-compliance. It comes only after a petition was filed to the Kauai Planning Commission to enforce a Notice of Violation sent by Kauai County Planning Department for non-compliance on their shortage of parking of nearly 89 missing parking stalls (from their original requirement back in the 70's) and a 4th notice against their the operation of un-permitted lockouts - adding up to an 146 additional units to the approved 134 condos in a residential zone.

This parking plan, shown in their response to the petition filed to the Kauai Planning Commission has serious flaws and could potentially open many including the County of Kauai to unforeseen liability claims. 

Instead of creating legitimate marked parking stalls, the parking plan shows perpendicular parked vehicles in areas which do not have the physical space and proper code clearance (20') for fire access. Allowing this plan to pass without thorough analysis on premise, without getting approval from homeowners - most who are unware of this plan, without receiving approval from homeowners whose units values will be affected by the proposed 26 parking spaces in front of their lanais, without providing details on how it would be managed (24/7 Valet) and who would pay for this service, without consulting valet experts, without providing details on who would bear the liability for accidents in the already tight areas of the current parking lots, and without providing any other information on whether such a plan would allow for the use of lockouts (which would require even more parking).

Some required parking stalls shown have disclaimers stating only to be used for special events, yet these are required stalls that were never put in for the 134 condos and commercial units at Hanalei Bay Resort. This plan is on its face value is disingenuous and in our opinion a complete SHAM - submitted after two years of delay.

Not to mention, the required 89 stalls shown in this plan are overstated - and without proper and safe distances between parked vehicles. Even without this form of stacked parking there have been numerous accidents within the narrow parking lots at HBR.

Additionally, by allowing this sort of parking in a resort will create new standards for other commercial projects where required parking allocations will be substituted by this form of stacked parking. Thus far, all major commercial projects have had to adhere to strict parking requirements and meet code requirements. Why is Hanalei Bay Resort about to be given a green light for this plan and what is the hurry to get this approved? Again, we pray and humbly ask Kauai Planning to reconsider rushing this plan through.

There is a hearing scheduled in front of the Planning Commission this coming Tuesday September 10, 2019. We seek the public's support in favor of this moratorium by signing our petition and requesting the Kauai Planning Department allow input from all parties involved and affected by this parking plan. Those who can personally attend the hearing would be greatly appreciated as well.
