In 2010 the Kansas State enacted changes to the existing laws of Kansas, modifing sections 21-4603(d)(1).

We are seeking to restore the language that in part states that if recommended [by the Topeka correctional facility], a less severe penalty be imposed in lieu of that originally adjudged within statutory limits and shall modify unless the court finds and sets forth with particularity the reasons for finding that the safety of members of the public will be jeopardized or that the welfare of the inmate will not be served by such modification.

Besides restoring the previous language, we are seeking to expand those offenders who would be affected by having the statute modified to include consideration of all offenders within the Kansas Dept. of Corrections.

Making the changes will help reduce prison population, reward inmate rehabilitation efforts and provide a method to reduce COVID 19 infection potential.
