I believe that by  Title 64.2. Wills, Trusts, and Fiduciaries » Subtitle II. Wills and Decedents' Estates » Chapter 4. Wills » Article 1. Requisites and Execution » § 64.2-401, entitled "Who may make a will; what estate may be disposed of" should be amended. The law states that " An individual is not capable of making a will if he is...an unemancipated minor.". This law restricts non emancipated minors who are in situations where they must ensure their financial assets is not squandered, whether that be by unfit parents or guardians, or others who could possibly come in contact with the minors financial assets. To ensure that a minor does not misuse the money, or that no minor is forced into making a will that benefits the person forcing the minor, I propose we petition to amend the document, instead of repealing it entirely, and change it to a reasonable age, where a minor is mature and capable of handling his financial assets.

This amendment would be crucial to financially responsible non emancipated minors who wish to create a will to protect their assets. I propose an eligibility test be administered to all minors wishing to create a will, to ensure that they are not of unsound mind, and to ensure that they are financially responsible. Please help this cause, and help the minors of Virginia.
