Why this petition matters

Started by Jenai Burns

Hello world

My name is Jenai Burns, I'm 19 years old and the youngest of five(5) children. In 2010 my oldest brother was arrested for first degree murder and has been unlawfully incarcerated ever since. In 2012 Judge James Rhodes found my brother guilty of first degree murder. Despite not believing the states only theory of the crime abused his discretion and convicted my brother under an accountability theory even though he was only charged and tried as the shooter. They were unable to prove him guilty in 2012 but he has been unlawfully and unjustly incarcerated ever since. In 2013 he received a 35 year sentence and has since been incarcerated in Menard Correctional Center. A correction center people refer to as "The Pit" because it is built in an old rock quarry. At Menard, because it is a maximum security prison, they are a 23 and 1. Meaning they are only allowed out one(1) hour a day and spend the other 23 hours in their cell. Ever since COVID they have to spend 24 hours a day in their cell except Five(5) hours they get on the yard twice a week. Can you imagine that, being locked in a room smaller than your bathroom all day everyday? My parents had to make a choice, invest in my other three(3) brothers and I's future or my brother's freedom. They chose my brothers and I; What's amazing is that Jason isn't mad. He feels that my parents made the right choice despite it costing him his freedom and I appreciate him for that. But my brother has missed birthdays, graduations, my brothers and I going off to college, and a lot more milestones over 13 years. Jason deserves his freedom so that he won't miss anything else. There's nothing I want more than for my oldest brother to watch me walk across the last and biggest stage of my life. Please if you can find it in your hearts to share this petition around and bring attention and awareness to our situation that, unfortunately, isn't so uncommon so I can help get the attention of States Attorney Kim Fox to help my brother get the justice he deserves. I personally and on the behalf of Jason and the rest of our family appreciate you for taking the time to read my brothers story. Thank you all and have a blessed New Year.
