We are reaching out to our dear friends, family and acquaintances to support us with getting justice for Kieran Sodhi who, on Monday 29th July 2019, was sentenced to four years imprisonment, and ordered to register as a sex offender for life, for a crime he did not commit!

It must be publicised to the UK Criminal Justice System that Kieran Sodhi is not a man of bad character, and certainly does not deserve the harsh punishment that he has been unfairly given!

If I could ask you to please spare five minutes of your day to read the following facts, which will hopefully give you an insight into how wrong and unfair this whole situation is. It would be greatly appreciated by us, Kieran’s immediate family, and Kieran himself.

First of all, the media have distorted the story so much, and it’s unfair that Kieran has been portrayed in the manner that he has. I would like to break down certain factors so that you all know and understand the truth:

  • The media stated that the woman and Kieran were attending separate functions at the same hotel - LIE - Both Kieran and the woman were attending the same function. They were colleagues attending a Christmas function, and had been acquainted previously at other work events.
  • It was reported that Kieran "tricked" hotel staff into giving him a duplicate room key, because he knew her address details - LIE - Kieran did not sign into the attendee’s sheet for the function and this has been proven by showing the jury the log in sheet from the night in question. Therefore, he would not have seen or known the woman's address or other personal details. FACT - The Hotel staff have lied to cover their own back and "policies". They lied about the fact that Kieran gave them her address details to obtain a room key - He did not do this, and still does not know of her details.
  • FACT - The hotel staff admitted under oath that it was possible for them to have issued a room key without asking Kieran to confirm the security questions.
  • FACT - Kieran had told the hotel staff he was a colleague of the woman and that he was concerned for her well-being as she was not responding to him knocking on her door.  He then asked hotel staff to call her room - there was still no response.  Only then did he ask for her room key.  Yes, on hindsight he should have asked a member of the hotel staff to accompany him, but at that time he was more concerned about her well-being.  Does the hotel not have a duty of care towards their guests?  Why didn’t they explain procedures and have someone from the hotel check up on the woman in question? These events were in Kieran’s police statements and are supported by the CCTV footage obtained by the hotel.
  • FACT - Kieran's 31-year-old cousin brother did pass away due to choking on his own vomit whilst he was under the influence in January 2015. He and Kieran were exceptionally close, and his death left Kieran heartbroken. Kieran had immediately flown to India to help perform the last rights of his cousin brother, unbeknown to him how horrific and gruesome Sikh funerals are.  It is due to this major event in his life that he has since been tormented and often breaks down over the loss of his brother.  It also meant that Kieran had since became more aware about caring for those around him who may put themselves in a similar position due to drinking too much. Anyone who has been drinking too much when they're around Kieran can vouch for the fact that he always has a duty of care towards everyone.  This was supported by one of his character references who stated that Kieran has always been the “dad of the group” and “always looked out for me and the other colleagues.”
  • It is also worth noting that his trial was held in Warwick Crown Court, in front of an all-white, all middle-aged, middle-class jury.  How is that a fair representation?  How was that a fair illustration of the UK's population/culture?  How can an all-white jury understand what happens at a Sikh funeral?  How can they understand what values a British Indian Sikh family are bought up with?  Or how Sikhs uphold women with the utmost respect and that our foundation is based on humanitarianism.  How was that a fair trial?  Without even understanding the case, would the jury not have looked at the “brown boy” on trial and made their initial assumptions about him regardless? 
  • Thanks to the constant influence of the media, is the general assumption towards Brown/Asian men portrayed fairly, regardless of what faith they come from?  Since Kieran’s trial began, his story has been published in several newspapers including national Papers such as The Mirror and The Metro.  Why have the newspapers given Kieran’s story so much coverage? So much so, that his story had its own dedicated full-page spread?  Why have the newspapers focused in so much to a story in that the “victim” herself states that it is possible that she undressed herself; and not once has she stated that she was sexually assaulted or in fact, had any concerns regarding Kieran on that Christmas function.  Therefore, how and why have the newspapers branded Kieran as a “Pervert?”  Why have the papers not made it blatantly apparent that he is of Sikh faith, or are they leaving it for the general readers to make their assumptions?
  • Judge Andrew Lockhart QC said on the day that Kieran was given his sentence: “It is important to note he went there with an intent, but there’s no evidence he did anything.” How, therefore, can this judge see it fit to lock Kieran away for 4 years and order him to register as a sex offender FOR LIFE?!
  • When sentencing Kieran, the judge told him: “This has turned her whole world upside-down. She doesn’t know what happened in that room, and she has to live with that." - What about Kieran? - He's been sentenced for something he didn't do, because he showed a duty of care, and now must live with that! Kieran remembers everything that happened that night. This whole saga has tarnished his reputation, his relationships, his personal well-being, and his mental health! What justice does he get?  He has been living with this over his head on bail since January 2017.  He has since lost his career, his livelihood, his marriage, his and his family’s reputation.  This saga has caused a serious impact on his mental health; which has caused him to seek medical assistance and medication.
  • The Judge also said “I take the view you decided she was an attractive young woman, and you were keen to be with her. Any man would have known she was close to incapable of speaking. She had to be taken to her room, close-on unconscious. My findings are that you entered that room intending to commit a sexual offence. You did not do so, but it must have been very frightening for her.” - How can the judge merely assume that Kieran decided "he was keen to be with her"?! A key part of the story was missed here, because the woman was in fact capable of speaking, as her and Kieran had conversed when he first took her the glass of water. She was also aware that Kieran said that he would check in on her again - She did not reject or decline his suggestion.  Kieran stood by his word and did exactly that. Now that she doesn't remember anything, she's punishing Kieran in an unimaginable way.
  • Judge Andrew Lockhart QC commented: “It is important to note he went there with an intent, but there’s no evidence he did anything.” - LIE - Kieran did not go there with any intent, other than to make sure the woman was safe! Is this what you get nowadays for showing compassion and a sense of humanity whilst looking after your peers?!

Secondly, let's take a moment to look at Judge Andrew Lockhart's recent conviction history in cases with a nature revolving around sex offences:

The Charge: After already having served two jail terms for sex offences, this defendant pleaded guilty to six charges of indecent assault!

The Sentence: Judge Andrew Lockhart QC gave him a community sentence with supervision for three years and ordered the defendant to take part in a three-year sex offender group work programme and to register as a sex offender for five years.

Kieran has been sentenced to four years in prison and ordered to register on the sex offenders register for life! How is this fair?

The Charge: The defendant pleaded guilty to three charges of making indecent images of children!

The Sentence: Judge Andrew Lockhart QC sentenced him to 8 months in prison suspended for two years and was ordered to take part in a rehabilitation activity and to carry out 100 hours of unpaid work. In addition, he was told he would have to register as a sex offender for ten years.

Again, compared to this case, how is Kieran's sentence fair? Just because the Judge and Jury think that Kieran might or might not have had some intention to maybe do something?! Is it fair to convict someone so severely based on assumptions?!

3. Ex-BBC presenters jailed for sex assaults on under-age boys, 2017: - Click to read full story

The Charge: This couple were found guilty of encouraging and grooming six boys to take part in sexual activities.

The Sentence: Judge Andrew Lockhart QC sentenced them both to five years in prison and to register as sex offenders for life.

These two individuals were sentenced to just one year more than Kieran for what they did to those six young boys. How is it fair that Kieran is sentenced to four years in prison for allegedly intending to do something, when this couple were sentenced to just one more year for actually assaulting young boys?!

4. Warwick man gets suspended sentence after police found 325 indecent images of children on hard drive, 2018: - Click to read full story

The Charge: This man pleaded guilty to three charges of making indecent images of children.

The Sentence: Judge Andrew Lockhart QC sentenced him to nine months in prison suspended for two years, and to register as a sex offender for ten years.

Again, another defendant pleading guilty to actually committing a crime, and was given a ‘lenient’ sentence when compared to Kieran's sentencing.

How is this fair justice toward Kieran?

5. Pervert jailed following repeated child pornography searches, 2018: - Click to read full story

The Charge: This man pleaded guilty to three charges of making indecent images of children and one of possessing prohibited images of children.

The Sentence: Judge Andrew Lockhart QC jailed him for eight months and ordered him to register as a sex offender for ten years.

This man is a potential threat to the safety of young children and got to walk free after a few months. How is it fair that Kieran is sentenced to four years in prison and registering as a sex offender for life for allegedly intending to do something?

The Charge: This man was convicted of three charges of sexual assault, after he sexually assaulted a woman in her own home.

The Sentence: Judge Andrew Lockhart QC sentenced him to two years in prison and ordered him to register as a sex offender for ten years.

This man physically assaulted a woman, and yet he was sentenced to two years less than Kieran, and only 10 years on the register!

How is this fair justice toward Kieran?

Anyone who knows Kieran, personally or professionally, would say he is a kind, gentle and caring person. He is from a well-respected Sikh family within the community and does not have a malicious nature.

He is a proud Grandson of an 85yr old grandmother.

He is a responsible Son, who looks after his parents.

He is a devoted Father to his 5-year-old daughter.

He is a supportive Brother to two older Sisters and their respective Husbands.

He is a wonderful Uncle to his Nieces and Nephews.

He is a hard-working member of a team of colleagues.

He is a loyal friend to all that he knows and is loved dearly.

Kieran was charged with:

  • Trespass, with the intent to commit a sexual assault
  • Committing a sexual assault.

Having had his case presented in Crown Court, to an all-white, middle-aged, middle-class jury, the verdict by jury was guilty on the first charge.  However, the jury could not agree on the second charge.  The “victim” was then given the option to either pursue or drop the second charge.  She chose to drop the second charge…. Why?  If you have been a victim of sexual assault, why would you not want justice?  Where is the logic in that?

All Kieran did, was show a duty of care toward a colleague; a young woman who had drank too much alcohol.  The media has blown this story out of proportion! There is CCTV footage which shows exactly what Kieran did, which is nothing malicious at all! 

Not once, in her police statement or in court did the woman express any discomfort, unease, or any cause for concern over Kieran or his behaviour around her.  Nor did she state through any stage that she was sexually assaulted.  When the two awoke the following morning, she found Kieran fully dressed and on the bed.  She had then asked Kieran if she was in his room, to that he responded no.  She then asked if anything had happened between the two, Kieran responded no.  He then got off the bed and explained why he was there and that he is leaving.  He then reassured her that nothing had happened between them and then asked if she was OK and then left. 

Are these the actions of a sexual predator?  If he was to assault her, why would he have then stayed the night?  Why would he have not “escaped” when he had the chance?  Why would he wake in the morning and converse with her, instead of running out of that room as fast as possible?

When he was unexpectedly arrested a few days after, under the allegation of RAPE, he cooperated and told a true account of what happened that evening! He fully cooperated with the Police and provided everything that they had asked for, including DNA sampling; Kieran also denied the request for legal representation, because in his defence, he had nothing to hide and was in a clear position to recall every aspect of the night in question.

Whereas the woman, supposedly has no recollection of that evening, but automatically assumed that "the worst has happened". Kieran has been prosecuted because this woman "thinks" something "might have" happened but does not remember!

We see this happening in films or TV shows, but this our reality; that Kieran has been sentenced for a crime he did not and had no intention to commit!

Please show your support for Kieran by signing this petition, so that we can start the appeal process and get Kieran out of prison and off the Sex Offenders Register!

He is not a criminal, and he does not belong in prison and he most certainly is not a Sex Offender!
