The Issue
A 49-year-old Hamilton man who booted Felix the Chihuahua is facing jail time after being convicted of two animal abuse charges. Ellison and his partner were apparently upset with the 3.5-kilogram animal because it had pooped inside the house.
On February 8, 2012 Robert Ellison was found guilty by Ontario Court Justice Bernd Zabel of permitting pain and suffering to an animal and threatening to kill an animal. The convictions stem from a dog-kicking incident in June 2011 in the Hamilton Mountain home of dog owner Ewa Stachurska, Ellison’s partner. Ellison, who appeared angered by the convictions, was remanded out of custody pending a presentence report.
Zabel told court he found the evidence of Stachurska’s next-door neighbour S. Hassan at the two-day trial last November 2011 to be “frank, straightforward and direct in testimony.” Hassan testified she witnessed Ellison kick the dog and hit it repeatedly with a plastic lawn chair it was cowering under. Court also viewed a poor quality cell phone video that Hassan’s brother recorded of the assault on Felix.
Prosecutor Giulia Gambacorta advised court she will seek jail time for Ellison and she added she will seek a court order that would prohibit Ellison from having any control over the animal but outside court, Gambacorta said that because Felix belongs to Stachurska, the mother of Ellison’s two children, the dog’s fate remains a question mark.
Ellison, who has 11 previous criminal convictions from 1982 to 2000, was overheard muttering about “euthanasia” as he stormed out of the courtroom with Stachurska. Following the court verdict, Ellison contacted The Hamilton Spectator to advise that the dog will be euthanized after Ellison pays the latest $580 kennel fee.
