Conduct an investigation into the shooting death of 19 year old Ariston Waiters by Officer Luther Lewis!

On December 14, 2011, in Union City, GA, Officer Luther Lewis, shot and killed unarmed 19 year old Ariston Waiters. Reports state that, Ariston Waiters, was face down on the ground when office Lewis shot him twice in the back. All the evidence indicate that there was no probable cause for Officer Lewis to confront the young African-American male. We believe there are serious and substantial issues that remain surrounding the death of Ariston Waiters.

BACKGROUND INFORMATION:

The Union City Police Department responded to a call that someone fired a pistol during a fight between several middle school & high school students. According to witness accounts when the police arrived, officer Luther Lewis, without reason, singled out Ariston Waiters and ordered him face down on the ground, which young Waiters fully complied with. All the evidence indicates young Ariston Waiters was not involved in the fight and was not near the group that was fighting. From this point just why Lewis shot young Ariston is confusing.

According to Officer Lewis, he put one knee in Ariston’s back and after placing one wrist in cuffs, young Ariston attempted to grab his weapon with the other hand. Never explained, is the physics of “how can a young 145 lb man, face down on the ground, one hand cuffed, with the knee of an over 200 pound trained police office pressed in his back, reach for and grab that officer’s weapon?”

OFFICER LUTHER LEWIS WAS NOT INDICTED:

The extraordinary issue in this case has to do with not only the handling of the investigation by the District Attorney office, but a clearly unconstitutional Georgia law that allowed officer Lewis to sit in on the Grand Jury proceedings (and to speak and rebutt eyewitness testimony that was given):

1. The District Attorney interviewed 50 witnesses, but selected to present the testimony only a few to the Grand Jury.

2. Completely ignoring the traditional purpose and intent of Grand Jury Secrecy and Witness Protection, the Georgia legislature passed legislation that allows accused politicians and police officers to sit in during grand jury witness testimonyand to speak after eyewitnesses have given their testimony. This law is a dangerous precedent that threatens unintimidated witness testimony before grand jury and could be instituted in states throughout the country.

With this petition, we are demanding an independent Federal Civil Rights investigation into the circumstances surrounding the death of Ariston Waiters to determine the extent of civil rights violations or other violations of federal law that were committed by the Georgia District Attorney and Officer Lewis.
