Ms. Lynch,

I am writing in reference to signage CVS Pharmacy has placed on the doors and windows of its stores in New Hampshire claiming that by state mandate face covering are mandatory for entry as well as the actions of its employees in carrying out policies that violate the emergency order (masking mandate), state and federal public access laws and our rights.

This is a formal notice of trespass and violation of New Hampshire Emergency Order #74 issued by Governor Christopher T. Sununu on which states the following:

Emergency Order #74
An order requiring persons to wear masks or cloth face coverings when in public spaces without physical distancing

Section 5. This Order shall not apply to the following:

b)  Any person with a medical condition or disability that prevents wearing a mask or other face covering;


Section 7. A person who declines to wear a mask or cloth face covering because of a medical or developmental issue, or difficulty breathing, shall not be required to produce documentation, or other evidence, verifying the condition.

I and others throughout the state that do not wear a mask in accordance with the provisions of  Emergency Order #74 will be recording these violations by CVS Pharmacy employees. In response to these violations resulting from CVS Pharmacy signage, training and policies, we may take the following actions:

1. If an officer is called, present the officer with a copy of Emergency Order #74, NH RSA 354:A TITLE XXXI TRADE AND COMMERCE, a copy of the Americans with Disabilities Act, and a copy of this letter as proof that CVS Health/CVS Pharmacy was given written notice of the these documents and its violations,
2. Press charges against CVS Pharmacy employees,
3. File suits individually and jointly as a class action against CVS Health.
