Madam Mayor & City Council members,

It has come to the attention of myself and a handful of the property owners living on Magnesia Falls and Joshua Road that the Planning Commission will be considering a Conditional Use Permit application for a proposed late-night, drive-thru restaurant (In-N-Out Burger) on the corner of Magnesia Falls Drive and Highway 111.  My neighbors and I are extremely concerned about the traffic and noise that will be generated by the project.  We all like In-N-Out burgers but lets be honest, this is not a good project for this site.  It has always been a sit down restaurant, and we believe the site is just too small and too close to residential uses to be compatible with the immediate neighborhood.  

We would like the Commission and City Council to be aware of the growing public outcry and to, at the very least, continue the item to a date uncertain, to require that the applicant prepare a traffic study conducted in season, prepare a noise study, and to advise staff to expand their notification to include all property owners on lower Magnesia Falls and Joshua Road.  The property owners would also like me to express that exempting the project under Section 15332 (in-fill projects) of the California Environmental Quality Act guidelines is in appropriate due to the fact that the project WILL have an impact on Noise & Traffic (see Section 15332(d)).   To prove my point - they say a picture is worth a thousand words.   That being said, take a look at the (link) photographs showing how In-N-Outs can impact their surroundings (or Google In n Out traffic pictures, for yourself).    Please look at the aerial images showing the stacking of cars/traffic.   This is not a "less than significant" impact nor will being open until 1 A.M. adjacent to the quiet residential street.  There are also recent stories I have read on the crime and trash generated.     Please keep our City a world-class city and site projects like this in more appropriate locations.
