JUSTICE FOR ANTHONY!!
My name is Alyssia Lujan I am 27 years old. I am starting this petition on behalf of my fiancé Anthony Medina, 29 of Sacramento, who is currently serving a LWOP sentence plus 2 more life sentences with the possibility of parole. He qualifies for the new aiding & abetting law along with him being only 19 when the crimes took place. He should qualify for the juvenile parole hearing but when you look up his name on inmate locator it says LWOP not eligible. I am hoping it is because we are at the federal level still fighting to appeal these cruel & unusual punishment sentences?? He just turned in his habeas corpus early September of this year so I'm praying that's why it says he doesn't qualify?
He didn't receive a fair trial at all.He was the only Hispanic out of him & his 2 co-defendants with tattoos who "looks like he is mean or is mad" but he is actually the opposite! He is loving & caring, always joking, making people laugh. I myself always look mad when I don't smile & so I am always getting judged that I'm something I'm not & that is exactly what the jury did before he even had a chance to defend himself. This is a rare case that happened in 2008 & was on the local Sacramento news. He was wrongfully convicted off of he said she said statements! Mind you, the witnesses weren't even credible because they were extremely high off meth the night of the crime! The victim's girlfriend couldn't even identify Anthony in more than one line up! Each time she chose someone different & neither time did she identify him! So how is that credible? Being on drugs clouds your judgment & you hallucinate. There was no evidence! No gun, no shell casings! Nothing that indicated Anthony had part in the killing of Jason Fletcher. He DID NOT aid & abed anything like the D.A proclaimed. He was simply at the wrong place, at the wrong time. He waited 3 1/2 years in the Sac County Jail before trial started in 2011. The jury found him GUILTY on all charges except he was found NOT GUILTY of having a firearm. He isn't a gang member & I am hoping & praying you take the time to dig a little deeper & relook at his case. Actually I am begging you from the bottom of my heart! He is a good man. He's made mistakes like all of us have, but he deserves this chance more than anyone I know. He will tell you he caught this case as a boy & transferred to prison as a man.
He is rehabilitating himself without even realizing it. Anthony currently has a job in prison, he mentors 3 juvenile boys who are locked up in L.A & he tells them they don't want to end up like him & they can do better. & the best part is they are listening! They told him he is an inspiration to them. He knows how to draw really well & his drawings have always been personal to him, but he decided on his own he wanted to donate them to St. Jude Children's Hospital for the kids battling cancer. He said, "So they can feel better & eat their food." They laminate his drawings & put them under their dinner trays to motivate them to eat. He stopped getting into fights going to the hole or getting write-ups way before he hit prison, he stopped all that nonsense in the County Jail. All he does is go to work, work out, play basketball which is his favorite & read books. & anyone in that prison or who knows him will tell you Anthony is a good guy. When someone tries to provoke him, he walks away. He is fighting for his life & he knows nobody is worth him getting in trouble for. He is very intelligent in all subjects & good at all sports. If he didn't grow up in the environment he did, he could of been anything he wanted to be in life! His favorite subjects are math & history. He's so smart that when he was studying to re-take his GED test (because juvenile hall lost his records of completing it) he was ahead of the class & his instructor in KVSP was amazed at how advanced he was & told him he's ready for the test but would have to wait until everyone else caught up to him.
He wants a college degree in business & has goals. He's always going out of his way for others with the upmost loyalty & respect & that's what ended up being his downfall in catching this case was because he trusted the wrong people! If you ask him now he will tell you, if he would of known his friend was going to kill anyone he wouldn't of went. Because of his ex best friend's stupidity they are no longer friends & Anthony is being punished for something he didn't do! We all deserve to pay for our mistakes but these 3 life sentences is just cruel. As far as the other case goes, he feared for his life when a car was trying to tailgate him & rear end him off the road! He will tell you he was literally scared for his life! We all know South Sacramento is a war zone. He will tell you, he pointed the gun down because he didn't want to kill nobody in the car that was trying to kill him. He didn't know what else to do! He swerved out the way & they kept on pursuing him saying "get that nigga right there!", while the victim reached under his seat real fast! & you can ask anyone who grew up in South Sacramento that means they want to kill you & are reaching for a gun under the seat because that is where they put them for "easy access" & to hide from the cops. The D.A sarcastically joked in court & said, "How did we know the victim wasn't reaching for a soda?" Really? A soda! Under the seat!? I didn't find that humorous at all! Can a car not kill someone? Therefore it should be viewed as a deadly weapon just like the gun was! Which means the victims aren't as innocent as the D.A proclaimed them to be. They were trying to kill Anthony with their car! & when that dnt work, they were going to pull out a gun! Anthony was just protecting himself in self-defense as anyone who is being threatened would. But he didn't kill anyone! The bullets just grazed the victim's knees because he pointed the gun down!
Sure not all inmates deserve a second chance but Anthony does. I can't speak for every inmate but I can speak up for mine! He's made a complete turnaround. His sentence is way too severe for these crimes & the part he had to take in them. He deserves clemency. The system has failed him tremendously! Based off judging him off of his race, the way he looks, & his juvenile past. I am hoping & praying this touches your heart in some way, shape or form. I am writing you on behalf of my fiancé Anthony Medina of Sacramento. He didn't receive a fair trial due to prosecution misconduct, being judged off his race being the only Hispanic, and off his looks being the only one with visible tattoos. If you want to judge a book by its cover, people can say he "looks mean or mad" but the truth is he is the opposite! He is goofy, always making everyone laugh, and has a huge heart who is always thinking of others. Nobody, not even his enemies can say anything bad about him! They judged him without even considering listening to his testimony. He shouldn't be serving LWOP plus 2 life sentences with the possibility of parole for something he didn't do! He should be accountable for his actions and his actions ONLY! He doesn't deserve to die in there! His sentence is cruel and unusual punishment. He deserves clemency and to be free! He has already spent almost 10 years incarcerated. The whole investigation and trial was fraudulent. The judge threw out any evidence that proved Anthony's innocence! They convicted him off of testimony from a drug addict that was extremely high off meth the night of the crime. How is that a credible witness? The victim's girlfriend was the only witness the prosecutor had besides the little girl who's house it happened in front of. Other than that, they had nothing and they knew it! How can they throw out the fact that she was high? They knew they wouldn't of had a case! Drug addicts lie, that's what they do! She couldn't even pick Anthony out of multiple line ups! Then she couldn't make up her mind wether he had a gun or not. The D.A tried using Anthony's words against him saying he didn't leave because he said "the gun shots sounded close". OF COURSE gun shots are going to sound close no matter where you are far or near because they are loud! He didn't even see the shooting happen because when he seen his co-defendants pull out their gun, he walked away, back towards his car! Doesn't his actions prove he wanted nothing to do with it? But yet they threw that out too that it was irrelevant. It doesn't matter if his friend ran to his car to get in, Anthony didn't know where the gun shots were coming from! For all he knew he was the one who got shot or his friend! The D.A shared in court that Anthony had told Morton "after this don't fuckin talk to me!" Does that not indicate that Anthony was pissed off at his friend's actions? So how did he aid and abed? But yet the D.A fabricated the truth! He twisted it for his own pleasure! How is it an attempted robbery when the drugs belonged to the shooter? How can you steal something that belongs to you? They didn't steal anything, therefore it wasn't an attempted robbery! The D.A knew he was full of it because he tried throwing in that they tried stealing the victim's car! Dnt nobody want that bucket old car of his! The jury found them NOT GUILTY of car jacking so how was it a robbery? It wasn't! Therefore there is no felony murder! Because in an attempt to rob someone & somebody dies under CA law it's automatic felony murder rule but there was no robbery, so therefore he shouldn't of been sentenced LWOP for it! He left and had no part of it! He wasn't purposely waiting around for his friend to jump in! His words when the shooter got in Anthony's car explains it all! Anthony was not okay with that! The victim's girlfriend testified that Jason Fletcher had said he was going to bring his friend for "muscle" so the victim had no intentions of making the drug deal right from the beginning! Jason Fletcher was seeking trouble but yet the jury was blind to that too! The victim didn't like that the shooter was black so he kept calling him a "nigger" The girlfriend even got on the stand and admitted Jason Fletcher was a racist! The D.A didn't care about that truth either! If the victim's girlfriend would have told the shooter they had smoked some of the dope and that's why it was "short", Jason Fletcher probably wouldn't have died! But no, they kept their mouths shut! In the attempted 1st degree murder case the D.A even laughed in court saying that "how did we not know the victims weren't reaching for a soda under the seat?" Nobody has a soda lying under the seat! While the victims were saying "get that nigga right there!" "Nigga" meaning guy not "nigger" the D.A tried to distinguish the two saying they were referring to Anthony's black friend Brandon Morton (the shooter in the other case) and don't know why Anthony fired the gun, but it was Anthony the victims Ramos & Granadoz were referring too! Morton was sitting in the backseat, they weren't worried about him! Those two words don't even mean the same thing in slang! Ask anyone who grew up around gun violence and they will tell you what Granadoz and Ramos were doing and saying means your life is in danger! Anthony was scared for his life! But yet they dismissed that too! They ignored the fact that the victims were pursuing Anthony in their car trying to PURPOSELY swerve into him! Can a car not kill someone? Then why isn't the car being considered a deadly weapon like the gun? Therefore he acted out in self-defense! How is it attempted murder when he wasn't trying to kill anyone and nobody died or got seriously hurt? The bullets barely grazed their knees! They were in the lane right next to him! Anthony could have easily blew their brains out, but he didn't because he's not a killer! The D.A made it seem like he chased them down when he didn't. He was heading down that direction towards Franklin Blvd so either way he had to go that way. But yet they ignored that fact also! Those so called "victims" were not as innocent as the D.A made them out to be! How is it that Granadoz and Ramos are validated gang members but the judge dismissed that too! They had pictures in their phone throwing up gang signs and red clothing in their car but yet the D.A told the jury to forget about that too! Sarantis even testified she ran into them and they said they were going to kill her! But yet the D.A made it seem like they are some innocent victims that deserve justice! Sounds like criminals to me! Those "victims" hid that gun before they went to seek help for their injuries just like Morton did! And that's why the D.A swore up and down that they never found one! Anthony isn't a gang member and had a lot of enemies trying to kill him! But yet they didn't use that for Antony's defense either in court! He shouldn't be serving life for that! That is cruel and unusual punishment! What would you have done if someone was pursuing you like that in their car and it was late at night with nobody around? Would you not be scared for your life? Anthony has paid enough for these crimes and he deserves to be free! This sentence he was given is just ridiculous! They ignored all the facts and went off of fabricated lies! Anthony's past shouldn't be used against him. Doesn't your juvenile record expunge when you turn 18? Then why is it that that's what he was convicted and sentenced over was his past? He got the worst sentence out of all three of them when he didn't even kill anyone! Everybody makes mistakes! NOBODY is perfect! Anthony has paid enough of his life for all his mistakes and deserves justice! The D.A, the judge, the jury all denied the facts and brushed it under the rug! All they saw was a Hispanic male who looks mad with tattoos, who has a past! They didn't care about the truth, just what it looked like to them instead of what it is! If you would dig a little deeper you would see this is all wrong! Anthony's Constitutional rights were broken! The D.A and everyone involved needs to be held accountable for their actions and misjudgment! There was one juror who even wasn't sure about the verdict! She even stood up and said they made a mistake and changed the verdict to NOT GUILTY of possession of a firearm! So what does that tell you? The victim's girlfriend lied about seeing him with a gun as did the D.A! Everyone for "the people" looked at her with intimidation because it had been a long 2 1/2 weeks and all they wanted to do was go home! Even the jury is guilty of misconduct! How is this justice? I am asking you to look at the facts! Don't concentrate on what the shooter did, concentrate on what that has to do with Anthony? I'm asking that he get out on time served for shooting at the vehicle and the LWOP dropped. No more life sentences! They aren't right! They don't fix anything! They are cruel and unusual! Anthony doesn't deserve that! He is making a difference in three juveniles' lives from the inside of prison! He mentors them through letters and they are listening! He's making a change. He's giving back for the mistakes he has made in life. He's giving back to kids battling cancer. He's doing amazing things because he is an amazing person! The only mistake he made was making the wrong friend! Please consider changing his circumstances and letting him come home to me, his kids, and his family.
