Baldwin and Sons, the builders of The Oaks at Portola Hills in Portola Hills, California has rejected all reasonable request for them to contribute towards the required repairs and redevelopment of the failed irrigation system which has resulted in plant failure in the communities common area parkways.

In addition to their negligence and lack of care, the builder controls the HOA Board 2 (Builder) to 1 (Homeowner) and does not represent the homeowners best interest for a long term solution by repairing the irrigation system, replacing the dead plants and reducing reoccurring maintenance cost associated with the common area parkway failure.

The Oaks at Portola Hills being a newly established community and as a result of the HOA Boards failure to establish an adequate reserve funding plan, there is limited equity within the HOA budget to redevelop the common areas parkways. 

Therefore the unified homeowners of The Oaks at Portola Hills are demanding,

  1. The HOA Board to cease additional allocation of HOA funds and reject any action for landscape redevelopment in parkways for 90 days.
  2. The establishment of a Landscape Oversight Committee with homeowner representation from each Phase for a total of Five (5) Non-HOA Board Members
  3. Review and approval from Homeowner Landscape Oversight Committee prior to the HOA Board allocating HOA funds or acting upon any landscaping matters.

This will ensure time for required due diligence by Homeowners Landscape Oversight Committee to identify a sustainable landscape solution for common area parkways. Establish equal homeowner representation with a unified voice for common area landscaping matters. Most importantly balance authority between builder controlled HOA Board and Homeowners.
