RESOLUTION OF THE JAMES CITY COUNTY BOARD OF SUPERVISORS
WHEREAS, the Constitution of Virginia Article 1 section 1 states, “That all men are by nature equally free and independent and have certain inherent rights, of which, when they enter into a state of society, they cannot, by any compact, deprive or divest their posterity; namely, the enjoyment of life and liberty, with the means of acquiring and possessing property, and pursuing and obtaining happiness and safety.” And,


WHEREAS, the Constitution of Virginia Article 1 section 12 states, “That the freedoms of speech and of the press are among the great bulwarks of liberty, and can never be restrained except by despotic governments; that any citizen may freely speak, write, and publish his sentiments on all subjects, being responsible for the abuse of that right; that the General Assembly shall not pass any law abridging the freedom of speech or of the press, nor the right of the people peaceably to assemble, and to petition the government for the redress of grievances.” And,
WHEREAS, Governor Northam, through an unlegislated order, is prohibiting the gathering of more than 25 citizens at a single time; and,
WHEREAS this order is clearly in violation of the Constitution of Virginia Article 1 and sections 1 and 12; and,


THEREFORE, the James City County Board of Supervisors does not recognize the Governor’s decree pursuant to the Constitution of Virginia Article 1 section 2 which states, “That all power is vested in, and consequently derived from, the people, that magistrates are their trustees and servants, and at all times amenable to them.” And,


THEREFORE, the James City County Board of Supervisors shall therefore direct its Chief of Police and any other Official, Employee or Agent under its employ or control charged with enforcing such unconstitutional order of the Governor, to disregard such unconstitutional orders and prevent the enforcement of such unconstitutional orders against the citizens of James City County, the Commonwealth of Virginia and the United States of America.
THEREFORE, the James City County Board of Supervisors Directs its Commonwealth’s Attorney to not prosecute the unconstitutional mandates prohibiting the people’s right to peaceably assemble; and,


THEREFORE, the James City County Board of Supervisors shall notify the Superintendent of the Williamsburg – James City County Schools of its requirement to open all WJCC Schools for in person learning on a full time basis beginning no later than January 11, 2021 including the resumption of all extracurricular activities in existence prior to March 15, 2020; and should the Williamsburg James City County School Board and Administration fail or refuse to open all schools as required, the James City County Board of Supervisors shall direct its Director of Finance to withhold all funding to the Williamsburg James City County Schools until such time as the requirement has been met.


BE IT RESOLVED, that the James City County Board of Supervisors will NOT allow the citizens of James City County to be subject to the unconstitutional tyranny of the Governor, and will fund the legal defense of its officers, Chief of Police, Sheriff, and Commonwealth’s Attorney to uphold their solemn oath to uphold the Virginia Constitution.


FURTHER BE IT RESOLVED, that based upon scientifically verified truths surrounding Covid 19 and its effect on and transmission by persons under the age of 18,the James City County Board of Supervisors recognizes the critical need for in person learning to mitigate damages to James City County citizens and children by the Williamsburg James City County School Board and Administration’s failure to open schools for in person learning, and agrees to fund its pro rata share of additional costs incurred by Williamsburg James City County Schools in opening all of its facilities for in person learning including but not limited to personal protective equipment, Covid 19 testing, sanitation and cleaning measures beyond standard operating procedures and such other costs and expenses necessary to protect the health of students, teachers, staff and administrators in an amount not to exceed Five Million Dollars ($5,000,000.00) which funding shall be made immediately available to WJCC Schools upon its agreement to meet this requirement.
