Many large corporations, such as hospitals, can not allow hiring a person as a contractor and an employee. Many people can be more useful to the company with both a W-2 (employee) and 1099 (contractor) numbers. Many contractor jobs are as needed jobs. Between the contractor is needed they could work for an hourly wage in a different department. Unfortunately, this is hard for a large company to allow. The problem lies with tax filing with IRS. There is not a section on the form for a company to specifically put people with both a 1099 and W-2 number. In the past when they had a few people who they allowed to have the benefit of doing this, they have gotten red-flagged by the IRS and had to be audited. Even though they were found to have not done anything wrong, the auditing cost the company (not the IRS) time and money. They finally ruled out allowing people to be both contracted and employed for these large companies. This then causes problems for the individual looking to center all their work in one area.
For instance, I am a medical massage therapist, contracted with our wonderful local hospital's wellness center. The center has child-care available for my children. I only get paid while I am giving a massage. Some weeks I might get 6 hours of massaging, other weeks I might get 15. It can be very unsteady. At lunchtime and on Saturdays, I normally do not have a massage scheduled. They are looking for someone who can cover the front desk as we have our employee front desk person going to lunch or off, even though the center is open. I have offered to help with these gaps, but I would have to have an employee number too. The hospital now has a rule that nobody can have both numbers in the company. Because of the lack of steady work in one location, I now have to get a second job and find a babysitter for two days out of the week. I am not the only person affected by this. Many different kinds of contractors are working for many big companies. They could easily double as employees also, but won't have a chance because of one missing section on the IRS filing forms. If they just put two extra questions... #.) Do you have anyone that has both a 1099 and W-2 number? #b.) If so how many? This will give the IRS a head's up and if what they find is the same number as answered on #b.) then there is no reason to red flag and audit the company.
