Greater Manchester Police to dismiss the 4 officers who unlawfully hospitalised Jonaya

0 have signed. Let’s get to 5,000!

My name is Jonaya, I am a political activist and in 2018 I began reporting death and rape threats from  extremists to Greater Manchester Police. They consistently refused to investigate and even threatened me with arrest when reporting the threats. The police then attempted to maliciously prosecute me on two occasions in 2018 but today I would like to draw your attention to the first incident which resulted in me receiving serious injuries and a consequent hospital admission.

On 12 August 2018, I went into Ashton-under-Lyne police station to report further threats. Instead of investigating, they unlawfully arrested me and violently assaulted me to such an extent that I had to attend hospital and suffered damage to my knee for 4/5 months afterwards as well as various other injuries. I was never charged (let alone convicted) of the alleged offence and I am currently in the process of suing them for assault/ battery and false imprisonment with DPP Law.

As the arrest was unlawful, it follows that any force used against me was also unlawful. The police do not have the power to use force against someone to arrest them if the arrest itself is not lawful - if any force is used or contact made in an unlawful arrest then the police officers involved may be liable for the criminal offence/ tort (civil) of assault/ battery. However, the force used against me in this particular circumstance was so excessive, that it amounts to an offence of assault occasioning actual bodily harm (ABH) contrary to s 47 of the Offences Against the Person Act 1861-  which is an aggravated form of assault and a criminal offence. For such a vicious and unprovoked attack, all four of the officers need to lose their jobs; it is in the public interest.

Additionally, if the relevant authorities refuse to prosecute these officers then I will, in time, bring my own private prosecution against them. But first of all, I need your help by signing this petition; you can help draw attention to the issue of rampant police misconduct, put the pressure on and protect your fellow citizens and yourself from these bullies.

Thank you.

The officers are:

1. PC 15212 MICHAEL FAHY (male 1).

2. PC 17032 SMITH (female 1).

3. Unknown at present (female 2).

4. Unknown at present (male 2).
