At present Gabriela has been forced into hiding because her husband, with the help of corrupt judges in Mexico City, has filed fictitious charges against her with the purpose of incarcerating her so that she cannot fight to have her children returned to her. Even though the Federal court has granted her full custody of her children the state courts refuse to act in accordance with the laws in place and continue to allow this harassment. According to the government of Yucatan, Gabriela's husband is a fugitive of the law for having embezzled money from the state of Tabasco. Despite this nothing has been done to help Gabriela recover her children, protect their welfare, and protect Gabriela from continuous false charges. It is obvious that the court of the Yucatan is protecting Martin Alberto Medina Sonda from the law. Gabriela continues to fear for her life and the life of the children she has not seen in nearly a year and a half.
The following is taken from an article in “Proceso” magazine, September 15, 2012 and is just an example of what Gabriela and her children have had to endure so far:
“The Yucatan Connexion with Granier. (Note: Granier is the ex-governor of Tabasco State, he is now in jail for stealing more than two hundred million pesos from the treasury.)
Let’s remember that at four in the afternoon on the 25th of May, 2012 three Suburbans in which judicial police officers from the State of Tabasco were traveling, surrounded Ema Gabriela Molina Canto who driving on the main road of Mexico development (Colonia Mexico) in Merida, Yucatan, Mexico. Ema Gabriela was driving with her three children: Mariana (8 years old, Martin (6 years old), and Isabella (4 years old).
Out of one of the Suburbans came Martin Alberto Medina Sonda, Ema Gabriela’s husband and father of the children. According to Ema Gabriela he was aiming a gun at her and pulled Isabella, the youngest of the children down from the car. Martin (the middle child) fainted and the oldest one Mariana asked to be left with their babysitter Suemmy.
Since that afternoon, Ema Gabriela has not seen her children. The police officer from Tabasco took her to Tabasco under the accusation of “illegal retention of a car”. A car owned by her husband. Ema Gabriela was incarcerated for four months, even though she was innocent as stated in the records of the Penal Court of the Third Court of Tabasco recorded under the number 99/2012. After she was finally released from the jail, her innocence confirmed, she went back to Merida, Yucatan in order to get her children back, however, the judge of family matters Sandra Bermejo Burgos denied Ema Gabriela the right to see her children even though she had ruled in Ema Gabriela’s favor in regards to custody in 2011.”
The story this article tells is just the beginning of Gabriela’s nightmare. She only wants the legal right to have her children, which she has already been granted, to be enforced and the harassment and fear tactics to stop.
