Innovative Oak Garden resident welfare association(IOG RWA) is attributing maintenance and corpus collection in unfair manner.
As per the apartment ownership law in karnataka, apartment maintenance is to be attributed per the Undivided Share owned by each owners, which is proportional to the square feet owned by each owners. However, RWA has raised invoice of Rs.10000 for corpus collection which is same for all owners. Also, the maintenance is being increased equally for all apartment owners for last 2 years, and the fixed part of maintenance is more than 70% of the expenses which is unfairly benefiting the larger apartment owners.
Attribution per square feet/UDS rationale is simple. Everything that owners spend on like security, electricity, water, cleaning, cctv etc are owned by apartment owners in proportion of their UDS(undivided share of land). Cost towards pool and gym maintenance(less than 20k per month) is very very low compared to all other charges(about 5 to 6 lakh a month). So all things which are done on UDS needs to be allocated proportionately based on UDS.
We contend that this unfair and illegal exercise of attributing maintenance NOT based on square feet/UDS be stopped immediately and maintenance attribution must be done based on square feet/UDS owned by each owners.
