N.D. has been incarcerated on his 19th birthday and was released three years later,  despite the unjust treatment of his case no one was held accountable. In December of 2018 he was at a Chinese food restaurant, which he frequented and where many locals were familiar with him. On this day, the owner asked him to leave. He suffers from mental health issue and had not been taking his medications, believed the owner was about to strike him so, in self-defense, he struck him, resulting in the current charge of 2nd degree robbery and 2nd degree aggravated assault. Even though no Robbery took place. His maternal aunt was a probation officer in the Middlesex County, NJ and has advocated for him in the past. Aware of the protocol in familial matters, she reported the involved member and his case was deemed a conflict and transferred out of the county to Union County. The case was transferred back to Middlesex county in a retaliatory attempt against his maternal aunt, whom had become embroiled in an EEOC complaint against the County for discrimination, harassment and retaliation. His aunt later filed a lawsuit in federal court and it's currently underway. She also filed a lawsuit in State Court. His public defender pressured him to keep the case in the county and sign a plea, informing him that if he did not sign, the incarceration term would be lengthier. His Public Defender never advocated on his behalf. They forced him to sign a plea with No Early Release and he was deemed a violent felon. This was his first adult offense and he has a history of mental health issues. After his aunt's lawsuit was filed, detailing the unscrupulous actions of the Middlesex County Courts, Middlesex County Public Defender and the Middlesex County Prosecutor. A new private attorney was appointed to his case. The new counsel immediately filed a motion to withdraw the coerced plea, citing his mental health diagnoses. From the onset, this attorney knew he should have never received the plea based on his mental health issues. What’s more, in an evaluation completed September 2020 it was determined that he qualifies for a not guilty defense due to his mental health status, yet the Middlesex County prosecutor refused to withdraw his plea. And Middlesex County Court judge sentenced him to three years in prison against medical advice. The family is searching for a Private Civil Attorney who can file a lawsuit to ensure this never happens again and to seek justice. He is in the process of appealing his illegal conviction. He should have never been sentenced to prison and he should have never been classified as a violent offender. Please contact the Middlesex County Prosecutor and Public Defender and request that his case is transferred out of the county as his aunt has five pending legal actions against the county. Please contact the NJ State Attorney General and demand an investigation into Middlesex County Courts. Three black former female employees currently have discrimination lawsuits against the court detailing a hostile work environment. The courts should not be able to go after a workers family member in retaliation for a lawsuit.
