HOWARD DOYLE IS INNOCENT, his C-Spire phone records prove he wasn't at the robbery of David Watson.  Officer Clifton Nelson testified that Joshua Smith told him that Howie (Howard) was helping to get the word out that Joshua Smith had a Samsung cell phone for sale. Officer Nelson became suspicious of Joshua because he didn't want to talk about any of the details of him talking to the man who wanted to meet with him to buy the cell phone. Howard's C-Spire records prove Howard was calling Joshua at the time of the robbery which happened between 8:43pm-8:49pm. The record shows Howard calling Joshua at 8:38pm, 8:50pm, multiple times until 5am. Joshua testified that they were using Joshua's phone because Howard's phone was dead, but the C-Spire records prove that wasn't true. On page 168 of Howard's trial transcript, Joshua testifies that David Watson, the robbery victim, never talked to Howard that Joshua pulled out his silver chrome gun to rob David and that is when David pulled out his gun. The 2 men struggled over David's gun and that is when Joshua was shot by David's gun. David Watson could not identify Howard Doyle in a line up. The Judge at trial states on page 303 of the trial transcript, "There is no proof in the record that this defendant, Howard, had any gun." Joshua testified on page 196-197, that he hadn't talked to anyone about the robbery but then he states that he talked to his god sister, Mashara, that he his brother Billy Ray Owens had robbed a guy and that he didn't mention anything to her about Howard being involved. Joshua testified, "I told Billy Ray to come back and help me, that he wasn't my brother." David Watson testified, "And in fact, one of them said, 'If you don't help me, you ain't my brother." And David answered yes. On page 238, Billy Ray testifies, "Cause Joshua was screaming and told me don't leave me!" On page 337-338 the trial Judge states, "But I guess it could be said that the "Motive" for Joshua Smith naming this defendant as a participant in the robbery was to protect his younger brother, but that just seems implausible to me." David Watson testified about a younger guy being involved in the robbery. Joshua Smith and Billy Ray Owens have a younger brother.
