Petition to ask Hassocks Parish Council to initiate a Judicial Review.

This petition asks Hassocks Parish Council to initiate a Judicial Review into the decision made by Mid Sussex District Council (MSDC) to grant planning consent at Friars Oak Fields under Planning Application DM/15/0626

A Judicial Review challenges the legal basis upon which a decision has been made and, to be successful, the decision must be deemed to be wrong in law.  

The recommendation of the case officer at MSDC failed to acknowledge that the Hassocks Neighbourhood Plan (NP) carried any weight. This is wrong in law as, having completed the Regulation 16 stage of Neighbourhood Planning, the emerging NP can be afforded weight in a planning decision. Furthermore, the recommendation was entirely contrary to and against the emerging Neighbourhood Plan.

If the Neighbourhood Plan is allowed to fail at this point, each and every one of the 15 sites we were asked to vote on could and would be built on. Imagine fifteen high-volume developments surrounding our village – it cannot be allowed to happen!

Should this appalling planning decision stand, then the Neighbourhood Plan would be in ruins. Consequently, to prevent ALL sites in Hassocks being built on, the NP must be saved.

Hassocks Parish Council holds significant reserves of tax-payer money. The community now asks the Parish Council to use some of this money to support the Neighbourhood Plan, to instigate a Judicial Review and, in thus doing, to allow the community to plan for sustainable development in Hassocks.
