Please note that a legal proceeding has been commenced by a few members in the Superior Court Justice against the current board of the ICCC. As you all know, the current board’s election was not approved by the members at the AGM in 2019, the members who attended the 2019 AGM asked for a fresh election under the supervision of a team of three past presidents who were present at the AGM (Mr. Ramesh Chotai, Mr. Sanjay Makkar, and Mr. Ajit Someshwar).  The nominations committee rejected the candidature of the multitude of suitable applicants without affording any reasons whatsoever. By this process, they reduced the number of eligible candidates and thereby circumvent the election process. For all these reasons, the members found the nomination committee’s selection process biased, lacked transparency and fairness and therefore requested for free and fair elections. Pramod Goyal and his team on the other hand blatantly ignored the members’ wishes and declared themselves as elected directors and forcefully occupied the chamber. The members tried to call for an SGM with a request for free and fair elections. Pramod rejects the SGM request on a technicality and has his friends call an SGM to replace the board,  but brings back the same board members through an electronic voting system where the members did not have a choice, either they vote for the members on the slate or abstain from voting. Again, the current board declared themselves elected at the SGM, about 100 members went to the SGM to oppose the board's actions, but their voices were not heard, Pramod walked away from the SGM just like the way he did at the AGM. The illegitimate board continued to occupy the chamber and then silenced the voice of any member who questioned the undemocratic process. Either their membership has been suspended or not renewed. Disgusted by the blatant unethical behavior by the illegitimate board, the multitude of long-standing members decided not to renew their membership.

The Applicants in the ongoing case are seeking the following relief:

  1. Declare the current board’s election null and void, as their selection/elections was not approved by the members at the 2019 AGM and therefore this board is illegitimate
  2. Conduct free and fair elections as per the members request in the 2019 AGM
  3. Restore membership of individuals whose membership has been suspended or denied renewal

Please support the court case to bring back Democracy and Accountability to the chamber.
