Why this petition matters

On June 21, 2007 Mr. Michael Wilson Jr. was sentence to 65 years for murder. After 2 hung jury trails/ mistrials. The prosecutor then entered in a new charge of battery. The judge allowed this charge. Michael was never questioned or asked about this charge in the presence of a jury. Michael does not have a history of battery.  The judge stated he is going to allow the charge to be entered however this case can be overturned by a higher court . This statement is on court transcripts

After  the trial Michael went for a direct appeal which was denied. The appeal it self was poorly written , presented, and litigated . Michael request for his appellate counsel to file a motion to correct errors which was never filed. This motion alone would of brought up the judge allowing a new charge to be entered battery

A motion to correct errors was never filed and sent as requested after the direct appeal( ineffective assistance) The Judge allowed a new charge (battery) that Mr. Wilson was not question or investigated about in the presence of a jury nor initially charged with to be entered. The Judge is on record and trial transcript  stating " an appellate court or supreme court will overturn case" (abuse of discretion).

It was never determine who actually shot the victim in this case nor were weapons found. Mr. Wilson has missed out on being a father to his  beautiful daughters. He just missed his oldest daughter sweet 16th birthday. The family wants nothing more but for Mr. Wilson to come home be with his family. His oldest daughter wants him to  see her walk across that stage and receive her H.S. diploma.  Mr. Wilson is new grandfather to a beautiful baby girl he has yet to meet. We do not want another generation of family to grow-up and Mr. Wilson to miss out on.

We the family are asking for the Indiana Attorney General and the Marion County Prosecutor to please review this case . A Conviction Integrity Unit  will be establish in Indiana in early  2021 that will work to prevent, identify and remedy wrongful convictions.

The family and Mr. Wilson feels he was wrongfully convicted and that undermines the integrity of the judicial system and does not bring justice to the victim.
