IN THE INTERESTS OF JUSTICE AND EQUALITY BEFORE THE LAW PRESIDENT CYRIL RAMAPHOSA MUST BE ARRESTED BY 05 JUNE 2022

The African National Revolutionary Youth Group (ANRYG) together with all concerned South African Citizens, petitioned for the arrest of President Ramaphosa with immediate effects.

Section 3, section 9, and Section 96 of the Constitution of the Republic of South Africa Act, 108 of 1996, respectively provide –

“3. CITIZENSHIP

1. There is a common South African citizenship.

2. All citizens are ¬

a. equally entitled to the rights, privileges, and benefits of citizenship; and

b. equally subject to the duties and responsibilities of citizenship”

“9. EQUALITY

1. Everyone is equal before the law and has the right to equal protection and benefit of the law.

2. Equality includes the full and equal enjoyment of all rights and freedoms. To promote the achievement of equality, legislative and other measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken.”

“96. CONDUCT OF CABINET MEMBERS AND DEPUTY MINISTERS

1. Members of the Cabinet and Deputy Ministers must act in accordance with a code of ethics prescribed by national legislation.

2. Members of the Cabinet and Deputy Ministers may not

a. undertake any other paid work;

b. act in any way that is inconsistent with their office, or exposes themselves to any situation involving the risk of a conflict between their official responsibilities and private interests; or

c. use their position or any information entrusted to them, to enrich themselves or improperly benefit any other person.”

All united South Africans regardless of their social standing are subject to the same Constitution and Rules of Law. There is no special Constitution for politicians or rich South Africans. Whether, one is a president of the country, or he is an unemployed street dweller, in the eyes of the RSA’s Constitution and Rules of Law, all South African citizens are equal before the law, are entitled to equal protection, benefits of the law, and also equally entitled to equal privileges, benefits, and rights without fear, bias and favor.

President Cyril Ramaphosa, just like any other South African citizen who has criminal cases opened against them, must be arrested, thereafter apply for the bail, and have his day in court to prove his innocence, after the prosecutor has charged them. The RSA criminal procedures should be equitably employed in the same manner and without any special preference; therefore President Cyril Ramaphosa must be arrested within 48 hours.

In terms of the Presidential oath of office as outlined in Schedule 2(1) of the Constitution, President Cyril Ramaphosa took an oath that he “will be faithful to the Republic of South Africa, and will obey, observe, uphold and maintain the Constitution and all other law of the Republic; and I solemnly and sincerely promise that I will always”

In keeping with section 96 of the Constitution, and in Schedule 2(1) of the Constitution, President Ramaphosa must hand himself to the Police Station for an immediate arrest.

Please sign and circulate this petition, demanding that the provisions of sections 3, 9, and 96 of the RSA Constitution be enforced without fear, favor, or bias, and accordingly just be manifestly seen to be done, and also demand President Ramaphosa must hand himself to the  South Africa Police Service (SAPS) an immediate arrest within 48 hours
