Bonnie Erwin, a 42 year old black man, was convicted by an all white jury in Texas of murder, kidnapping and conspiracy to distribute a controlled substance in 1984. He was sentenced to death by the judge and rapidly incarcerated in prison to await his execution.
In 1986, Petitioner Erwin appealed this case to the Fifth Circuit Court of Appeals and on July 3,1986, the court entered an opinion REVERSING the complete conspiracy conviction. The court barred the U.S. Government from retrying Petitioner Erwin on the conspiracy charges listed in Count One. The State of Texas, in cause 7-84-174, filed a Motion to Dismiss the entire case of murder and kidnapping because the real perpetrator had been identified. The resulting order dated April 12, 1989, dismissed ALL criminal action and discharged Petitioner Erwin in toto (completely).
Due to many convoluted legal twists and turns, Bonnie Erwin still languishes in a Texas federal prison (Beaumont Medium) where he has spent the past 32 years. He is now 74 years old and unable to walk without assistance. Bonnie is diabetic and has many health issues due to lack of proper healthcare. His requests for compassionate release have been routinely denied.
On the upside, Bonnie's sentence was reduced from DEATH to Life plus 120 Years for a murder that the State of Texas asserts he DID NOT COMMIT.
