We are currently researching the lack of laws around surrogacy, specifically the adoption process that intending parents have to go through to gain custody of their biological child.

Since there are minimal laws surrounding surrogacy, there is also a chance that should the surrogate mother not want to give up custody, they legally won’t have to. This also works vice versa if the intended parents do not want to keep the baby, thus leaving the baby with the surrogate mother to care for.

Our change that we are advocating for is to put in place a legally binding agreement between the surrogate and the intending parents to state that when the child is born, they will be under the intending parents custody with no need for adoption.
