We are a Scottish family living in NZ for 3 years now. My wife and I have been granted another work to residence visa as INZ aren't processing residency visas at the moment. In 2019 we had a baby girl here as we were planning on becoming residents. Before Rebecca's first birthday she had been referred to a Paediatrician as she wasn't hitting her milestones on time. This was the same time when we applied for the visas but immigration declined her visa stating she would be a burden to the health system! We appealed for a medical waiver as her Paediatrician disagreed with the conditions INZ states as being 'non ash' (acceptable standard of health) but this was again declined as their medical assessor says she could be a burden. At the point of receiving the decision Rebecca got a diagnosis of SCA 29. This is a rare, non progressive condition that affects her in infancy with her milestones, sitting, walking etc, but she will eventually catch up and should not need any extra support by the time she starts school. We only had 3 days to appeal their decision as her visa expired that week and she had to be here legally to do so. We are still waiting on INZ and we can't move forward with our lives as we don't know if we can stay or if they will deport our sweet 19 month old daughter.
