Javier was granted a three (3) month, 90 day extension by the DHS/ICE Office in Miramar a few weeks ago. This extension was based on the fact that DHS had issued a new reinstatement of his expedited order of removal from nearly 17 years ago - in December of 2001 - when he came to the USA and was detained at the Houston airport. As set forth in the immigration law and regulations, we have the absolute right to respond and contest this expedited order of removal. We have filed a petition for review with the Eleventh (11th) Circuit Court of Appeals, based in Atlanta, Georgia, and this petition is pending at this time.
