Today, Javier and I spent over 2 hours at the DHS/ICE office in Miramar, where he was "processed," by taking him into a room in the back (where attorneys they claim are "not allowed"), and for the next hour or so I waited hoping and praying that he was not being taken into custody and already on his way to Krome Detention Center or some other Immigration jail. Thankfully, he walked out - wearing the ankle bracelet monitor, like some kind of criminal. He then had to go to the next Immigration office in Delray Beach, which is like a sub-contractor (GEO) that handles these ankle bracelet monitor cases - where he has now been for another 4 hours, waiting with some 40 people ahead of him. He will have certain restrictions and conditions place on him as to when/where he can go - again as if he is either a criminal, a danger, or some kind of flight risk - all of which we ALL know he is NOT.
Worse, he has now been given 2 weeks to go back in with airplane tickets to return to Mexico, showing that he will leaving the USA a week later, on July 3rd. At this point, I would note that I had another client at Miramar today and he was taken into custody and even though I begged and pleaded for him to also be allowed on the ankle bracelet monitor, they refused. This is also a man with no criminal record a young US citizen stepchild with medical issues and a father who is a permanent resident also with medical issues. We have filed a waiver for this man - and he was still taken into custody. The manner in which people are treated - intimidated, threatened, and made to wait for MANY hours at Miramar - is unconscionable.
Time is now MORE than ever - of the essence. With all the work and petitions, appeals, waivers, an approved marriage petition, etc., NONE of this matters unless and until we can get a federal judge to act. We have exhausted all administrative remedies dealing with just about every agency under the DHS umbrella - CBP, ICE, USCIS, et al.
There is NO question that the expedited order of removal issued against Javier some 16 + years ago at the Houston airport was invalid and illegal, and in violation of federal regulations, the immigration laws, and the officers' own handbook and guidelines. NO person should be subject to coercion, threats, and intimidated into signing a sworn statement - especially a statement which says from the FIRST question that Javier did NOT know what was going and did NOT understand the officer's questions. No one should be threatened with jail for not signing a document they dont understand. Even after 9/11. We look forward to challenging what took place at that Houston airport over 16 years ago, and showing all of the violations and illegality of what took place. Javier was NEVER told he was issued an expedited order of removal OR that he had a 5 year bar from returning to the USA. He was given NO documents, had no right to an attorney or to see a judge, and summarily sent back to Mexico, after being treated like a criminal.
We again thank each of you for your support. Many have asked or wondered how in God's name it is possible for someone married to a US citizen, with 3 beautiful US citizen daughter, an approved marriage petition (approved by Immigration), a valid work permit (approved by Immigration), can be having such a difficult time. Immigration laws are complex and constantly evolving. Javier had the misfortune of facing angry immigration officers just after 9/11 at an airport who unilaterally made decisions against him, without any notice or explanation whatsoever. Decisions which continue to affect this man, his family, and this case for many years thereafter.
We will continue to keep everyone posted as we progress in this case. Time is definitely of the essence and we hope we have enough time to do all we can for Javier in his compelling and deserving case.
