BAD news! We just received word from DHS/ICE in Miramar that they will NOT grant our request for an extension for Javier. Here is the email: Good Afternoon Mr. Hujber, I have received your email requesting an extension for your client. In as such, he was denied a stay of removal. See the attached letter. His presence on 06/12/2018 is required due to the recent denial. We cannot extend the date at this time. We will review his case upon appearing at his scheduled appointment. I understand the concern you have indicated below. Yet, we are bound by federal regulation and the INA act to proceed with removal efforts due to an outstanding order of removal. Jose Velez Supervisor Detention and Deportation Officer Non Detained 2805 SW 145th Avenue Miramar, FL 33027 954-843-5906 (Office) The boss of Supervisor Velez is the Director of this DHS/ICE Office of ERO (Enforcement and Removal Operations). His name is Mr. Nigel Jason (954) 843-5906, and his email is nigel.a.jason@ice.dhs.gov. We ask that EVERYONE who signed the petition please contact these 2 DHS officials at Miramar and express support for our simple request - a 3 month extension for Javier so that we can fight this case in federal court. It makes absolutely NO sense for Javier to be arrested and jailed (and deported) at this time. His U.S. citizen wife and 3 beautiful US citizen daughters will suffer horrific hardship without him. Simply put, his arrest and deportation will be devastating to Javier, his wife, their children, and the entire community. We have a pending request for humanitarian parole, as well as certain appeals, which remain pending. In addition, we are preparing to file an action in federal court in West Palm Beach, challenging the illegal and invalid "expedited" order of removal issued against Javier nearly 17 years ago, just after the horrific terrorist attack of 9/11 at the Houston airport, when Javier was barely 20 years of age. In addition, we ask that those who support this compelling case COME OUT to Miramar on Tuesday at the address above at 11 a.m. to show DHS/ICE that there is a huge amount of support in the community for this man. We ask that this be a peaceful rally in support of this man and his family. This is NOT a protest or in an way an event where we want any anger or violence to be demonstrated by anyone or against anyone. The DHS/ICE office in Miramar is located just north of Miramar Parkway and just east of I-75. The specific address is listed above. We are extremely concerned that Javier will be arrested and deported on Tuesday, based on this e-mail and the circumstances in this case. It appears that time is truly running out in this important and compelling case. It has been my honor and pleasure to work vigorously to defend and assist Javier in his important and compelling case for several years now. I have grown close to this man and to his family. It is my genuine hope that DHS/ICE will allow him to "report" for this appointment, and then allow him to return home to his family. The possibility that this good man with absolutely NO criminal record may be arrested and deported is truly a shame and tragedy. And, it is something we should ALL be against.
