Unfortunately, our most recent stay of deportation/removal was just denied by the U.S. DHS/ICE office in Miramar, Florida. Even worse, Javier's next report date was moved up to June 12th, which leaves us essentially with only 10 days before he will be likely arrested and deported. This is very BAD news. The officer in charge of the case is Jose M. Velez. His contact information is provided in our newly updated petition, along with that of the Assistant Field Office Director for DHS/ICE in Miramar, Mr. Nigel Jason. U.S. DHS/CBP (Customs and Border Protection) refuses to revoke or rescind the old expedited order of deportation/removal illegally and wrongfully issued in this case 16 1/2 years ago - just after the horrific and tragic terrorist attack of 9/11/2001. As such, we are in the process of potentially filing an action in United States federal district court, seeking declaratory relief in this important case. We have essentially exhausted all our administrative remedies in this case. At this point, it is our hope that Javier will receive additional time from DHS/ICE in Miramar in order to take his case to a federal judge. We have fought this case for years, and have truly exhausted all possible administrative remedies from the various federal agencies involved in this case. It is now time for a federal judge to hear this case, and we now hope to be able to do so - but without Javier facing imminent arrest, detention, or deportation to Mexico, separated from his U.S. citizen wife and three (3) beautiful United States citizen daughters.
