We, the undersigned, rebut HB0158, the amendment to the State of Illinois’ Marriage and Dissolution of Marriage Act in regard to the presumption of equal parenting time to be awarded. This amendment is NOT in the best interest of the child(ren) and their need for stability.  The need for stability is better served when a primary residence is in place with respect to a majority of time spent at the primary home by the child. Psychological and sociological research has suggested that in most families there is a primary caregiver, regardless of the make-up of the household.  Being separated from one’s primary caregiver may cause emotional stress for the child(ren). HB0158 does not outline standards for households with great physical distance between them. Furthermore, the amendment will make it difficult to prove abuse, neglect, or maltreatment of the child.
