Joe has been incarcerated since 2001 for a murder that occurred 1997. There exists no physical evidence. No fingerprints that match him, no marks on his body, DNA evidence that excluded him, and no blood or DNA on his clothes..  No witnesses claimed to see him, he had an alibi, and police confirmed there was no transport route that could have taken him to the scene.

He was prosecuted based solely on a statement by a single witness; a statement signed under duress by an infrequently seen friend claiming Joe had confessed the murder to him.

A police-recorded phone call showing phone call showing this statement to be false was made admissible in court as hearsay by prosecution when it did not yield the evidence they hoped for, and in fact showed Joe maintaining his innocence and the witness agreeing.

Joe's sixth amendment right to confront the witness in court was violated. His defense was not allowed to use the call or transcript as evidence of his own statement.
